Have a question guys.... sold my car and there's a problem.

So I just sold my car today, 2002 Honda Accord. The buyer was a late 20s girl that paid with a certified check, and I already deposited it. Anyways, apparently my car's A/C was broke. Well, I didn't know this. I hadn't used the A/C for 4-5 months and the heat was working perfectly fine. So as I haven't used the A/C for almost 6 months, I had no idea it was broke. The lady called again 5 minutes ago saying the A/C isn't working. She wants me to pay for it. I told her there was no way I would pay for it as she should have checked it before she signed the papers and paid me. The bill of sale says the car is SOLD AS IS and this lady has been calling me every 10 minutes since 6 pm. I turned my cell phone off but what do you guys think? Legally, I am definitely not responsible. She signed the papers saying it is sold AS IS. I feel bad for her but hey, maybe she should have checked it before she left with my car? Would you have checked the A/C at this cold weather yourself?

If Bill of sale said "AS IS", its her responsibility. She should have checked it before signing anything and paying you. Next time she calls, pick up the phone and tell her that you havnt used the A/C in the past 4-5 months and it was her responsibility to check it before purchasing the car.

your okay, dont worry.

Most probably it is a leaking condensor and is going to cost ~$500 to get it fixed and refilled with the gas again.

I am not really worried as to what she can do... its just that I feel bad for her but at the same time, I didn't know it was broke. Heh... well... with the weather going so cold, I imagine I wouldn't have checked the A/C either if the heat was working properly ... too bad for her....

According to The Peoples Court, even if you don't say it's being sold as-is, cars are sold "buyer beware". So it's pretty much as-is unless you say otherwise.

Heh, thanks, but I don't really want to deal with her any more than necessary. If she bothers me too much, I'll refer her to my g/f (Stanford Law student) :)

There's always the possibility that her BF is a 300lbs 8ft tall muscleman, so then it would be caveat venditor :p

Didn't say anything about A/C... she asked for the VIN, checked it on Carfax, got clean info, arranged to meet at a Safeway parking lot, she got in driver's seat, drove for 15 minutes, the heat was working, then we signed papers, she paid me... pretty much all of it.

Same thing happened to me, although it was much more minor. Bought a '98 Cavalier early last year. Everything looked good, except that I realized that the antenna was broken a couple of days after I paid.
Wasn't too hard to fix, but I wondered how I missed that :eek:

Sucks for her. Somewhere out there all her myspace friends are probably cursing you for being a lowlife scum, but it's her own fault for not having it professionally checked out, ESPECIALLY when buying from a private seller. What the hell was she thinking? ... and why the hell would she check the A/C NOW, when it's still f'ing cold outside, but NOT when she was getting ready to buy it?

Answer the phone next time, tell her you have no legal requirement to repair this and that if she wishes to have any contact with you again regarding it then it better be from a lawyer or you are reporting her for harassment. Tell her that she has your address and any contact with you must be in mail.

Or, if you want the easy way, tell her take a long driver in her new car off of a short pier. (But she better not do it somewhere warm.)

She said the car shakes and idles rough when she turns on the A/C so I don't know whether that's something cheap to fix or not. Oh well, I don't care. Not my problem.
