rather interesting article which says that the president can go to war without congress supporting it but after 60 days and congress still hasnt shown its support and officialy declared war then the army has to be withdrawn. And it also states that yesterday the 60 day deadline passed.

Has war been declared by the US congress?

Good question. I'm totally for the hunt for Osama and a pro President Bush guy, but if the law says we need Congressional support, then we should wait for it. Hopefully they will vote on it right away.

I don't think that can you declare war on Taliban in the traditional sense, since Taliban is not the recognized government of Afganistan. USA is at war against terrorism (I dunno that have they officially declared war against terrorism), and through that, they are at war against Taleban.

Even if Bush had to get congress' approval for the declaration of war, I don't think he'd have any problems doing it.

I have no doubt about it either, just by law it has to be done, and by law it had to be done by yesterday, doesnt seem to have been done so by law the army must be withdrawn.

War Powers Act

<< 1) has declared war or has enacted a specific authorization for such use of United States Armed Forces, (2) has extended by law such sixty-day period, or (3) is physically unable to meet as a result of an armed >>

I'm fairly certain the Congress has given the President authorization.

Congress has authorized expenditures and granted approval, however they have not declared war.

The last time congress had the political guts to declare war was in 1941.

By congress not declaring war, they can not be held politcally accountable if something goes wrong.

Congress passed the resolution giving the President the authorization to use whatever force is needed. This replaces the need to formally declare war as is required in the War Measures Act and lets Congress of the hook and puts the burden on the President. There was a very good article on this I read a few days ago, I just can't remember where.
