Has anyone else noticed this about criminal trials?

People are more likely to be assumed guilty if:

a) When they are a minority and the victim is white
b) It involves mother/father and children or husband/wife
c) Involves sexual assault

Any others?



You better start kissing your ass if you get accused and (a | b | c) applies.

Generally they ARE guilty, and there is overwhelming evidence.

No, I havent noticed that. Besides, thats why they have trials based on evidence with an impartial jury.....

And if I could kiss my own ass I could aslo, well, lets just say I wouldn't be wasting this moment posting here and my g/f wouldn't be around anymore ;)

2. If you were killed, it was most likely someone in your family who done it.

3. Conviction rates on sexual assault are pretty low up here in Canada. Of course, this might be because our Crown attorneys try to bring every one of these cases to trial, in order to encourage victims to come forward. There have been a few well-publicized cases of accusers who were blatantly lying.

Canadians are more violent than Americans, ESPECIALLY in sexually related crimes.

I've said it many times before. God help you come home from work and find your house broken into and your wife raped and murdered. Not only will you have to deal with unbelievable anguish and grief of losing your loved one, but they'll frame you up for life in prison too. This is one reason why my SO has a CWP.

There was a special in PBS's frontline called "presumed guilty" which I think highlighted some injustices to our systems which places the poor accused at risk. The first was how the poor are afforded "public defenders" however in SF they only got about $2000 for a murder and much much less for other felonies. Not much to mount a defense if you know what lawyers/trails cost. Not only that the "public defeneders" are paid about half or less what their prosecutoral brethern make. Again, not much incentive for good personel to get hired there to defend you. Basically you're fusked if you got no cash and the state with it's comparitavlty unlimited budget says you did it.

Some other issues they raised was jurys just want to get out. So If a judge tells them they must come to an agreement , which judges often do, the "hold outs" for resonable doubt will capitulate and vote guilty.

Bunch of other stuff but I forget now, but race was never mentioned. What i took away from it was a) never be accused of a crime and b) if you are mortgage everything you got for adequete representation or your going to meet budda for sure.

I'm a little upset by that, I may write to StatsCan.

The British study, however, does clearly show that even including rape our crime rate was significantly lower than yours, up until 2000 (no data after that), althought there were signs of convergence.

Don't have the time to get into this AGAIN, but RELIABLE COMPLETE statistics have shown that Canadians are twice as violent as Americans, and the largest factor was the HIGHER SEXUAL CRIMES perpepuated by Canadians as opposed to Americans. How do I know this for FACT, because we have already gone through this here before.

I personally don't care what you THINK based on a couple of incomplete studies, but I am well aware of the facts. If you really want to know you will find out the truth, if not, you will believe as you will, won't change reality though. I'm willing to bet alot of the Canuck posters that have been here since P&N was started will remember this debate from before, it's old news.....
