His attorney legally requested a copy of the in jail video footage for review for their case and they denied them. The video shows some serious damage to the mans body. They broke his back btw, and he suffered hemorrhaging on the brain.

How can a city refuse to turn over evidence?

I think that was part of the reason this made news, because if I am understanding things correctly his attorney has a right to a full copy of the video.

Unless the court orders it then they don't have to turn over any video evidence.

I think you may be wrong on that. There is this thing called right to evidence disclosure. I recall that in any law suit or even in a defense case the attorneys for the defendant or the plaintiff have a right to all forms of evidence including video footage.

I am searching online now, but here is one that talks about CCTV video footage which I think is often times used in jails and prisons and the legalities concerning video footage are in this link. https://www.dataprotection.ie/docs/Data-Protection-CCTV/242.htm

I think when a civil legal case comes up the attorney files an application formal request for the footage and they have to turn that over within a reasonable time frame.

They are going to get sued anyways, based on the injuries alone, then judge will order release of the evidence. If they destroy it, it will be used against them in court.

I am sure he will win his lawsuit, he had several broken vertebrae (broken back) and a brain hemorrhage, he was in a semi coma for 4 days. Just the fact that the mayor and the jail are trying to keep the video from his lawyer is very telling and makes one wonder if they plan on altering the tapes/video.

No, their server will crash before any backups were taken. The cops will lie about the beating and say the guy fell in the cell.....repeatedly.
