Hard drive failing?

I just bought a Seagate 320GB SATA hard drive from Newegg last week. I was checking some email this morning, and Vista popped up with a window saying "Vista has detected one of your hard drives is failing." I checked in Everest, and the spin retry count was at 97, at threshold, and status said "Pre-failure, imminent loss of data is being predicted."

I haven't put anything on this new HD yet, should I just go ahead and file an RMA with Newegg? Just curious. Every other value in Everest is OK, just the spin retry count.

Yeah, the spin retry is at 97. I've gotten 2 error messages from Vista saying the hard drive might fail....

maybe time to return this HD.
