Hard drive dead on out of warranty apple TV

I had a backup of the OSBoot partition but not the recovery partition. I was able to get the ATV to boot with a new drive but I cannot update the software, stuck on 1.0

Two choices:
1. Pirate a copy of the OS
2. Go to an Apple store and pay Apple to give you a new hard drive.

One's illegal but probably ethical since you're obviously an owner of the device, the other's expensive....

I was afraid of as much. I may buy a used one and use that drive to repair this one, and make a back-up of the image.
