Half Life and Counter Strike's EULA

Anyone know if it's actually against Half Life and Counter Strike's EULA to make modifications? Such as using cheats? I'm in a debate with this guy who uses cheats and I'm defending Valve's right to ban his cd-key from all servers if he gets caught

he's not making a modification directly. he is using a third party application. as far as i know, if he bought the half life game, than he is entitled to also use the cheat as long as the cheats are not directly modifying any part of the half life coding nor content.

I'm pretty sure it's not against anything. A defense of this might be that he was using a game that he paid for and has the right to do whatever he wants with that. Technically, I think he does. Of course, I think he deserves a swift kick in the pants for using cheats, anyway, but that's not the point.

Remember that you don't own software just the right to use it the way they say you can...for example MS won't let you take the OS you get with one PC and use it on another PC you own, even if you wipe the first PC clean and put linux on it. Until some court case decides otherwise you have only the rights they say you have. Many EULAs say you may not modify the program and cheats generally do so (replacing part of the client).

The Program may include functionality designed to identify software or hardware processes or functionality that may give a player an unfair competitive advantage when playing multiplayer versions of any Valve software or modifications thereof ("Cheats"). You agree that you will not directly or indirectly disable, circumvent, or otherwise interfere with the operation of software designed to prevent or report the use of Cheats. You acknowledge and agree that either Valve or the online multiplayer host of the Program (or any other Valve product) may refuse to allow you to participate in online multiplayer games relating to this Program (or any other Valve product) if you use Cheats in connection with the Program (or any other Valve product). Further, you acknowledge and agree that an online host may report your use of Cheats to Valve, and Valve may communicate your history of use of Cheats to other online hosts of the Program (or any other Valve product).
