BINGO! I was just speculating this over in the Video forum: What if this is a scam to use FUD to stampede people into snapping up 9800s NOW instead of waiting to see if the R400s or NV40s are better? They'll be out before February and this could be a preemptive strike in case Nvidia decides their thumbs are warm enough and they come back huge with the NV40.
