They can get older firmware direct from Sony as part of their agreement. It's a bullshit argument, end of story.
I've been thinking about this Linux on PS3 thing and although at first I did not see it, one of the limitations of the PS3 is it's outdated browser, so if I can run Linux on my PS3 that means I can run Firefox and stream whatever format/site I want on my PS3 right?support full 1080p streaming of multiple formats directly to the PS3.

XBMC has yet to be ported, this is all speculation. One of the main things holding it back has been full access to the video hardware, but now we have it. I don't know if or when it will happen, but this is a step in the right direction.
As far as things that can work from the XMB, there is the Showtime Media Player. I haven't used it, but it can play from a uPnP server, and I'm not quite sure if it supports 1080p. I just want simple SMB share streaming of multiple formats, and that is what XBMC can provide.
