Overrated? Wow. And before they're tried they're being used to threaten people and violate civil liberties? Why should some individual or other organization have to pony up the cash to fight them? And of course any failed suits set a bad legal precedent. Thats why for example the EFF helped 2600 fight the DMCA/DeCSS mess but backed down. A bad judgement which looked possible would only set back the cause. No I tend to believe the goverment should be responsible enough to clean up their own mess and not make us just put up with it until someone else does.

Yes, somoeone needs to challenge it, but they can't. I recall some senators did question Ashcroft on this matter, and his only reply over and over was "You are supporting the terrorists". Can't really rationalize in such conditions can we?
