Doctor Claims Former Lover Stole His Sperm
Couple Never Had Intercourse, But Lover Got Pregnant
A Chicago doctor has won the right to sue his former lover because he claims she caused him distress by making him a father against his will.
Dr. Richard Phillips claims Sharon Irons stole his sperm and used it to impregnate herself six years ago.
Phillips' lawsuit contends that he and Irons never had intercourse but did have oral sex three times. He said Irons, without his knowledge, kept some of his semen and used it to impregnate herself.
A Cook County judge dismissed Phillips' lawsuit in 2003. But Tuesday an appeals court panel reinstated part of it and sent the case back to the lower court.
But the appeals panel did affirm the lower court's decision to dismiss fraud and theft claims against Irons. They agreed with Irons' lawyers that she didn't steal the sperm.
