Grr...any ideas on what to do regarding Circuit City?

Ok, so four weeks ago, I PM'ed a Mio Digiwalker 310x at Circuit City to CompUSA for $150. They didn't have any in stock, so they did a preorder and the salesman said it'll take a week.

Well, one week later, there is no call from Circuit City. I called them up and asked what's going on, and they said they have no information and that they'll call me when it arrives. I was kinda disappointed, but I waited some more.

One week after that, I actually went into the store to ask what's going on. The salesman on duty looked up information in their system and saw that there were only 7 units available from their distribution warehouse. He didn't know either when it'll arrive.

Two weeks after that (today), I go into the store to ask the manager what's going on. I notice that the 310x is discontinued in Circuit City now and the only available one is the floor model (open box). The manager looked up information on the system again and it shows there are 6 units in the distribution center. At that time, I was kinda angry since if there were 7 units two weeks ago, and 6 units now, WHY THE FVCK wasn't I given one in the time between?? The manager says the only thing he can do is either refund my money or give me the floor model. I said that I paid for a new retail product, and I shouldn't expect to receive an open box. We talked some more and the store director got involved. The store director pretty much reiterated that the only thing he could do was either give me a refund or give me the open box unit. He also told me that he cannot contact the distribution warehouse and that the system might also be wrong, which in my mind is BS, since how could he know the system was wrong if he has no contact with the distribution warehouse?

So here I am, four weeks with Circuit City sitting on my credit, and still without the GPS unit that I paid for. Any ideas on what else to do or who else to talk to?

Get your money back?
Those units probably don't exist they could have been stolen, lost, misplaced, etc

Let me make sure I understand this. You PM'd a price and expected the management team to jump through hoops to get you your item.

Don't get me wrong, I love PMs, rebates and MIRs as much as the next miser, but I also am realistic at what I'm doing. Retail staff (commission or not) have no incentive to help us misers get our deals.

get a refund. honestly, they don't owe you anything beyond that. they don't even have to order it for you in the first place.

FWIW, if there is that few in the warehouse, your not gonna get one. When i worked at CC, most items at the warehouse showed 100+, many well over 1000. If it was down to that few, many of those could be part of the variance (i.e. missing, sent to the wrong store and not accounted for, etc).

They should have just refused your PM in the first place since they didn't have it in stock. You should have just bought it at CompUSA if that's who had it on sale... I'd say you took a chance at buying it when it was OOS and you got unlucky. All they HAVE to do is cancel the order and say "Sorry, we can't get it any more".

I would have appreciated them doing that when the product was discontinued, but nope.
