Maybe, but I'm not his attorney, but if i were his attorney I think i might have said it exactly as it was stated...just for effectRight or wrong - that is their job - to get their client a "not-guilty" verdict no matter what. That is a big problem with our system - no morals, just money.

So, you do realize that any woman could see you leaving the subway and claim you fondled them or any woman you had sex with could say you raped them and you would be in this exact same situation..
PLUS.. Eagle County is 99% WHITE PEOPLE...AND that they recently settled a racial discrimination lawsuit brought against them.

Also, there is now apparently a discrepancy in her story when it comes to whether and to what extent she told Bryant "no" during the assault. The defense is going to try to use this discrepancy to portray this case as a "mixed signal" case -- a case in which Bryant honestly believed he had the woman's consent and immediately stopped once he realized he did not. Again, in order to convict Bryant, jurors may have to give the alleged victim the benefit of the doubt instead of the defendant -- and that isn't likely to happen.

I think this makes a huge difference in the case. As you correctly said, no means no. However, based on her past that can cause a reasonable doubt, especially since the tearing could have happened or started earlier than Kobe. If her accusations are true, by all means, I hope Kobe is convicted. However, it is better that a guilty man go free than an innocent man convicted. 1. How do you know? Her medical records are private, not to mention not admissible in court. Secondly she had just lost her closest friends. Your first smear congrats.
2. How does this matter? People often work when they are schedualed to. No one knew Kobe Bryant was coming, the Lakers didnt. he also checked in under an assumed name.

And yes they do have recorded and written statements by Kobe Bryant that are contradicting. The defense has motioned to get them to be inadmissible in court. However it is a futile attempt. As he was properly represented at the time, he was also fully aware of his rights at the time.
