Hell, I'm not even going out with someone I plan to marry, but I know if/when I do find someone I do want to marry, I am going to sign some sort of agreement beforehand.

Ok, just got off the phone with the x

me: Why is the honda still in my name?
x: I don't know??
me: Did you ever go to the DMV and transfer the title?
x: I didn't know I had to.
(when I signed the car over to her, she asked what she had to do, and I told her.)
me: you have two tickets here for blowing off the tolls on E-470
x: what??
me: I have tickets for "Toll Evasion", issued in my name, with pictures of the honda.
x: what does that mean?
me: It means you didn't pay the tolls on E-470
x: I thought you only had to pay the first one!

Just wow :(
I swear, she's not even blonde. I explained the whole DMV procedure for her using very small words.

In Washington, the seller and buyer sign the top portion of the title, and the bottom Report of Sale. The seller takes the Report of Sale, the buyer takes the title.
Then the seller goes to the DMV with the report of sale. This is NECESSARY in order for the seller not to be liable for what the buyer does.
It's up to the buyer to deal with transferring the title and registration.

Never trust the buyer to transfer the title. ALWAYS file a report of sale.

Apparently, my ex never bothered to follow through and register the car in her name after I signed the title over to her last summer.
What in F did you do that for without taking the tags off? Some damned imbecile I sold my car to a year ago actually asked if he could keep my plate on it "for a couple of weeks". Ah, sure buddy! I realize you know this woman better, but you still got screwed because of her :(

BTW when you sell a car/sign over title, you can go into the DMV and unregister it. I did that with mine in case the moron I sold my car to went and did anything stupid and it was still registered as mine.

In Washington at least, there's no need...as long as you file the report of sale, you are NOT legally liable for anything the next guy does. Even if he doesn't transfer the registration OR title.

The only time you would keep the plates is if they had several months left on the registration, and you wanted your money back...but that paperwork's a pain.

Be sure to send her an invoice for the tickets via CMRRR letter. Send a copy to her lawyer and yours, too.

Be sure to send her an invoice for the tickets via CMRRR letter. Send a copy to her lawyer and yours, too.

The E-470 people seem reasonable. I'll send in the paperwork and get them to transfer the tickets to her name. If that doesn't work within a week or so, I'll do the certified letter bit, although my lawyer has withdrawn, and I expect her's has also.

Yep - hindsite is 20/20. I don't know if Colorado does the "unregister" bit. I suppose they must in some fashion. There is a bill of sale that the buyer has to take in to transfer the title - never heard of a seller filing it. I guess I was a little clueless about that part of the process as well. But at least I pay my tolls!
