Got screwed by fedex. Need help please :'(

Hi guys. I sold a compaq evo n800c on here a while ago. Anyways the computer was brand new in the box and I have pictures showing so. So I sold the notebook for 400$ plus a pocket pc deemed worth 400$. I chose to send via fedex since they are considered the best. I insured the notebook for 2200$ CDN which is what I paid for the machine. I dropped the notebook off at my local copy/fax place and paid him around 100$CDN to be shipped. It was sent from vancouver to the recipient who lives in california. Upon recieving the notebook, the buyer opened up the box and discovered that the notebook was heavily damaged (lcd destroyed, casing cracked). He emailed me immediatly explaining the situation. I called fedex and they told me to have the manufacturer get an estimate on how much it would cost to fix the notebook. The estimate was more then what I insured it for. I then gave the estimate to the guy at my local copy/fax place since fedex says hes the shipper and he faxed that off to fedex. I then heard back from him about a week later and he told me that fedex has no record of the item being damaged and that they dont plan on repairing or re-imburing me the insurance. They offered me a gift basket, I told them very nicely to go f*ck themselves.

SO... I was hoping one of you guys could help me out. the notebook is still at the recipients home. Do any of you guys know what my best course of action is. Do you think its worth it calling a lawyer? Any help is appreciated

Well, if repair is higher than notebook cost that you paid. Why not just buy another for same price? Was that price when it was new?

Of course they wouldn't have "records" of it being damaged, that is, untill you brought it up with them.


Try a consumer action group from your local television station.

So if you damage someone's property you're responsible for it, but if a carrier damages your property that isn't insured or the cost exceed what you insured for, they're not legally liable?

Doesn't really matter, if they pay him his $2200 canadian (which is like $12.50 Us, right? :D), he can buy a new one.

I ship with fedex a lot and I have to file claims twice. Eventhough it took a while (about a month) to resolve it, but they always resolve it. You have to file/open a claim with fedex and ask for a case number. You have to get the recipient to take pictures of the damages and fax it to you and then you have to be the one who fax all the information to fedex (including your copy of receipt). I think you can download the claim form from fedex online and fill in the information there, don't rely on your shop guy to do it for you, because fedex is going to cut the check to whoever it is that file the claim or if noted otherwise by you. Trust me on this, I already done it twice.

Next, did you ship the laptop in its original manufacturer's packaging? and did you double box it with fedex authorize box? Yes, fedex has a special box to ship a laptop and it is free of charge if you ship it via fedex express. If you did not, you might not be reimbursed, because if you read carefully, for shipping computer stuff especially laptop or LCD, you have to follow the guideline otherwise you won't be reimbursed. I happen to know this because I shipped a laptop once. The fedex agent told me, there are too many people ship broken LCD or laptop and file a claim with them and they have to reimburse them, that's why the new rule now apply that the agent has to check the condition of the laptop or LCD if it is not sealed brand new from manufacturer. Then you have to double box it.

Main thing is, keep calling fedex. Customer service and claim department has different phone number. Ask for the claim department number and see who is handling you. They can not say that you never ship the package if you have the receipt, make a copy of everything. When I filed my claim, I asked for the claim number and I faxed the information over to fedex with all my claim # on every page and then I sent the hard copy directly to their office too. thanks so much. yes it was in the original manufacturers box, now as far as putting it in a second box im assuming it was since the kinkos place where i sent it knew it was a notebook and probably does this sorta thing a lot. im gonna contact the fedex claims department and im gonna look for that form you said. Ill call the recipient and tell him to send me pictures of the damage as well. anymore help would be appreciated. do you happen to know the phone number for the claims department or a certain individual who you worked with that can help me.

well i talked to one of the guys higher up in the claims department. his name is Jerry Pickard and he was an absolute prick. He pritty much told me too bad so sad, better luck next time. What horseshit, how do these companies get away with these scams

ok the thing is they refuse to talk to me about the case because im not the sender. they say the person who sent the package (the guy at my fax place) is the only one who can talk to them. it turns out that jerry pickard guy is the guy that was handling my case. Im thinking about calling back and asking for his supervisor.

Who is the guy that mailed it? - you should also work with the Kinkos - if FedEx tries to claim that the package was not packed to specs then THAT falls back on Kinkos. - When something is insured for the LARGE amount you insured it for then Kinkos is automatically supposed to ask questions and package it properly.
Definitely call back.. talk to the super...

Because they can. It's like those rebate companies that try try to avoid having to pay out on rebates for any small technicality they can come up with. I love FedEx but I think they are exhibiting poor customer service in this situation.

They gave me the name of one of the guys higher up, Forrest Lusper, I called his office, he left for the day so I left a msg hopefully he'll call me back monday.

its not that it wasnt packed correctly, from my understanding from what ive been told from this guy peter who sent out the item at the fax place, fedex said they have no record of damage occuring during transit and thats why they refuse to pay
