Whether I'm write or wrong is up to the court to decide. I've gotten off traffic tickets for the simple reason that the cop didn't show up. And speeding tickets are no exception.

Also, I don't think you realize how big of a douche bag you are.

Its up to the court to prove that he was, not vice versa. This isn't socialist New Zealand where sheep are easy pray and like to be romanced.

All he has to say is "I argue that the device incorrectly assessed my speed, I was going 45 and the device was off by 3 mph". "Here is factual data saying that radar devices of this kind can be off by as much as 5 mph +/- and here are court case's where such discrepancies were proven."

Then its up to the cop to first show up, which they don't always do - and prove that the defendant was speeding.

NOT in traffic court. To prove it to the court all they have to do is ask the officer. thats enough proof.

IT's up to you to PROVE the cop wrong.

Also in my experience a Officer always shows up. why wouldn't they? they are getting paid overtime for it.

2) You need to give more details because your story doesn't really make sense or add up. I don't know the legality of this, but aren't you allowed to have a +/- 5mph discrepancy between your speedometer and their radar gun?

I call shens. Unless it was a traffic jam, driving 3 MPH over the limit in Boston is more likely to get you a ticket for obstructing traffic than anything else.

Does the ticket actually say it was for 3 mph over the posted limit (ie, 58 in 55 zone)? School zone? Hospital zone?

I've never seen a 3 mph over ticket anywhere, town roads or highway.

Tell the prosecutor that you are sorry and ask if you can donate the full amount of the ticket to a charity and have the ticket be taken off your record. Done that before and got off once for driving in the HOV lane alooone.....

If he says no ask if you can take traffice school or any other option to have it not go into your driving record.

It is +/- 1MPH for stationary mode radar. +/- 2MPH for moving mode radar.
If it was paced using the cruiser speedometer, they need to prove it was
properly calibrated. And unless you were in a school zone (esp if kids were there)
you stand a good chance of pleading it down to a no points offense by talking to
the prosecutor when you get to court. They will ask who wants not guilty and give
you and him time to talk it over. It helps if your record is clean.

I got a speeding ticket and have a shot at overturning it. But I would like legal counsel if its even worth the effort or more importantly, $$$ fee for lawyer to show up in court. Court date is June 28th, so time is of essence.

Anyone know anyone in Boston, MA who has helped them overturn a speeding ticket? I could prob spend a few hundy for a lawyer to show up in court with me....

Not in MA. MA is an all or nothing state. You can reduce fine, but you cannot reduce the charge. No plea bargains. The best he can hope for now is getting a judge that will let him off if it is his first offense.

If you're serious, answer some of these questions.

1) How did he catch you speeding? (pacing, lidar, radar)
2) Where was it in MA?
3) In MA, if you appeal a ticket, you do not meet with the judge first, you meet with the Clerk Magistrate. I would show up and contest your ticket. He will probably lower the fine IE 75 in a 55 will usually be lowered to 65 in a 55. Some cases he will just throw it out. If you do not accept, then you can appeal and then next time around you will appear in front of the judge.

Answer those and it will be clearer.
