Got into a minor wreck about a week ago

dude settle down, i work for a law firm that does insurance defense and subrogation cases all the time. One of the partners said my best course of action is to just file the claim w/ my insurance company, let my insurance company try to sue the guy, and if they get enough $$ back they'll give me back my deductible. Not a ton of damage, no personal injury, no reason to get a lawyer involved really.

The only thing that bothers me is that this guy will probably never get cited, go to jail, or pay a dime over this accident that is causing me a sh!tstorm of hassles

So he didn't get cited for failure to yield?

If not, it makes it all the more important for you call the officer who wrote up the accident report and let him know the other driver was not insured.

The court system LOVES uninsured drivers-- they get to eat them alive with fees and penalties.

I went ahead and called and left the reporting officer a voice mail stating I would like the report amended and criminal charges filed if necessary. God that sounds like i'm being petty, but this frustration is pissing me off.

The report does not mention any citations. I think the guy knew the police officer, which makes this even more fun. When the officer walked up the other guy was like "hey man haven't seen you for a while"

ummmm did you explain this to your insurance company? your company is not going to want to pay out if this guy is insured. And obviously you wouldnt want them too. If the report says "insured" then he damned well better be insured. Report is gospel truth and is what your insurance will go by.... this makes no sense.

Long story short if the police report says "insured" then I can;t imagine your insurance would even contemplate paying for the repairs.
