About 3 hours ago, some dumbass ran a red light, and hit my car in the drivers side. He had a suspended license, and no insurance. The car he was driving belongs to his GF, and she at least has insurance on her car. Any thought from you guys as to what kind of insurance fight I'm about to go through?

The front driver door and back passenger door are stuck shut, and the inside plastic on my dash is compressed a little around the steering wheel. The window was inside the door, so it's shattered. Only good thing was I was wearing my seatbelt, so I didn't get tossed around, and there was no injuries at all.

In most states these days they are making penalties for driving w/o insurance way stiffer. Sue that guy for all he is worth (probably not much)! :p

I just hope it doesn't come down to me having to sue for damages. I'd rather just collect the insurance money and get a)the car fixed or b) new car from it being scraped. My car was bought for 1300, so it was just a drive around beater...but it was my beater. My mom's gonna let me use her car for work, so I won't be without a vehicle.

Actually, when my window is down, I tend to hang my arm out. For some reason today, I didn't. I had it in the car, or I might still be not here.

Insurance, in my experience, has typically gone w/the vehicle but, in this case, with driver having a suspended license, the owner's (his g/f) insurance may refuse to pay. In that case, you'd have to sue both him *and* her. If she's living with her parents, you could go after them, too.

*If* the other insurance company gives you hassles, look into hiring a personal injury lawyer (just don't pick the one w/the cheeziest TV ads ;) ) and go from there.

just report it to your insurance company. They will give you a check for the amount of the damage with no hassles minus your deductible. Once they get the money from the other insurance company, they will refund you your deductible. This is just alot simpler on your end and your insurance rate should not go up at all.

There are two possibilities, her insurance may pay for that if they were living together (this does not apply to all insurance companies though - 2 years ago, i drove my sister's car and got an accident, the insurance company paid even though my name was not on her policy).
Check with your insurance provider, see if you have uninsured/underinsured motorist on your policy. If you do, they will pay you (I think this has some deductible, depends on the provider). And they will go after the guy to get the money; let them deal with him, don't bother with any lawsuit or anything, it's not worth your time; your insurance provider has a full staff to deal with those people.

It's just strange. After I posted the first few messages here, I went to my friemds house to drink.....just got home after having 5 Blue Skies. I also realize I have a low trhreshold for alcohol. But I feel pretty good now.
