ummm, lawsuit.

If they honestly fired you because you applied for another job then that's a no-no.

-edit- sorry you got fired. Keep your head up and try to not let it bother you too much.

sorry to here that you got fired. but i guess things are on the upside since you applied to other places... perhaps higher pay?! and also, i guess its not good to tell your current employer that you applied to other places.

Damn, sorry to hear that. Hope everything on Monday turns out for the better for you.

Nice severance package though. It's better than many get.

I am an "at will" employee this means they can fire me when ever they want.

they said my performance had suffered in the past two months. Maily this was because the service cordinator quit and they never hired a new one. This left me to do about 25% more work. I was swamped. They decided to make a change. The IT will be taking over some of my duties because we really can't afford a full time IT guy.

One of the other techs is ACTIVILY PURSUING jobs and I applied for 2 jobs at the same company.

It depends on wether the state he works at has "at will employment". If they have at will employment, the reason for the firing doesn't matter.

When you are appling with a company that your current company does alot of bussiness with they will fund out. I would rather they found out from me.

I DO NOT regret informing them I had applied and that I didn't get the job;) went on vaction and then I get slammed today.

I told them if I was going to let a guy go because he was looking around it would be the dude that didn't let me know and they know he is looking.

yeah, unless there was documented proof of poor performance then you have a lawsuit on your hands...at will state or not.

I'm not one to advocate suing anybody, but your situation pretty cut and dry.

Good luck with what ever you do.

Sucks that they did it right after you come back from vacation! :frown:

Had they spoken with you about your drop in performance before now? I try to address the problem as soon as it starts in hopes of heading off the problem. Besides, I would never fire someone for looking/applying for other jobs...just silly if you ask me. I would start asking why they wanted to leave the current position.

why is everyon so quick to sue someone. Just because he got fired doesnt mean his life is over.

He was wrongly terminated. He deserves compensation. There are laws against that sort of thing.

good luck on the job application. in the future, make sure your employer doesn't know about future job applications...they don't like that for some reason.

Yeah,

I'd definately seek counsel ASAP if you want to pursue what seems like an open and shut case.

This was the first they had mentioned any performace problems.

The said it was more of a restructuring move than anything and because I was looking anyway they choose to let me go.

I am not going to sue, Whn I agreed to go to work for them I knew it was an at will employer and sorry but I have no desire to attack them. I am going to move on. If I can't find work in a few months I will become a competitor of theres.;)

Something to keep in mind if you don't get the other job. They cannot fire you for seeking another job, at will employment or not. It is not a valid reason for termination. If they even mentioned it when they fired you then you could sue them. Now if they were smart they never even mentioned that you were looking for another job and you would have a very difficult time proving a wrongfull termination suit.

They said that because I am looking to get a management job that they felt it was best that I be the one that was let go. It was mentioned.
