Got a speeding ticket...Help me fight it.

I was at a State Park yesterday doing some fishing. I decided to drive over the the next parking area about a quarter mile down the road. On the road between the two parking lots I passed a park ranger. I saw him turn around and then he pulled me over. He cited me for no seat belt and going 40mph in a 20mph zone.

Now the seat belt I can see, I usually where my seat belt but I really didn't think it was required on State park property. However, there was no way I was going 40mph. The way he clocked me wasn't by radar or laser but by PACE. How can you determine speed by pace when you're driving the opposite direction as someone??

I plan on going to court to fight the speeding part of the ticket. Anyone have any suggestions about fighting tickets or knowledge about determining speed by pace?
 
I recall someone saying there was a way they could estimate how fast you're going by using pace even in the other direction. I dunno what it is but I think there is one. If you're in California, try ticketassassin. Dont listen to the idiots that will reply "why dont' u just pay the fine and learn your lesson." If you can get out of it, do it, then be careful next time. If you get screwed again within 18 months then that really really sucks
 
If he doesn't have proof, I doubt he can do anything. Just hope he doesn't show up. Have some of your friends stage a robbery at your bank right when your court date is due. Then you would have nothing to worry about.

Normally I would say, "obey the laws of the road".

However, you may have a case for the speeding citation. I am not sure about where you live, but here radar is mandatory to convict on speeding. No radar, no ticket. I also have the right to see the radar unit and my clocked speed as well.

I say do some research first.
 
Remember One thing you where on STATE PROPERTY Many of the local statues do not apply. So if you are going to fight it be careful.

Well, if he was stationary and had a stop watch he could time you for a known distance and calculate your speed.

Also, WTF were you doing speeding in a state park anyway? Even 10 over is stupid in a park. You deserve the ticket you trash eating scum bag.

This wasn't the typical crowded state park. VERY VERY Rural, also I wasn't going 40mph either.
 
If it goes to the town you they will want to bump the tickets down to two parking tickets so the town and not the state gets the money. This happened to me a few times. Don't let this get out.... In my case it is truth.

When the DA said "okay we have you with speeding 53 in 35... How about we bump this down to two parking tickets and school?"
I replied "Well sir, I was hoping to forego the school and pay only one parking ticket." Bold huh?
DA: "And can you give me a good reason why I should do that?"
Me: "Well sir, I am active in the community. I participated in many fund raisers (stated some), and contribute to the community in other ways (stated ways).
DA: "Hmm?" LONG pause.... "Okay one parking ticket, have a good day Mr. TMPadmin"

In the beginning he looked at me as just another person to make some money off of for his town. At the end, he showed me respect. Now I did do those things I told him but...? 😉
 
even though hes not a cop, he can give out violation tickets, which sucks because the rangers have nothing better to do then cite people with some ghetto shiz. as for him clocking you, most cops or "higher authorities" are trained to clock people just with their site/hearing rather then use a radar. so they can indeed clock u and give u a ticket without using a radar. it all depends on your statement your going to use in court. you really have to make the ranger look stupid to get away with a ticket.

basically the reason you got a ticket at the end of the month is because frickin dumbass Bush wants them to do so... not Bush personally but his redirected personel... when you live in a country that spends $30,000,000 every hour on military, you gotta find some ways to create funds: such as ticketing speeders 😀
 
You showed a display of speed where it wasn't needed. A Park. I think that's what you should fight it for, that's only a 2 point ticket. I agree he should not of gave you a speeding ticket. Specially 40 mph, thats a 4 point ticket . For a guy who did not clock you thats a heafty ticket to shell out.

Were their kids running about or something? Maybe you showed carelessness.

There was NO ONE around. Park was empty. I didn't see anyone but the park ranger the entire time I was there.

Also in Ohio it's not a 4 point violation..Still a 2 point. If he would have marked me going 41 though it would have been considered a wreckless operation which is 4 points.

...and for all the people saying "just pay the ticket loser" GET OFF YOUR HIGH HORSE. This is America and I have every right to contest the ticket in court. The cops only reason for giving me this ticket was that he "thought" I was going too fast. He has no real proof. There's a big difference for insurace purposes for tickets that are more than 15mph over.

I'm going to court next week. I've done some research an have basically concluded it's impossible to determine speed by pace when in motion traveling the opposite direction. Can anyone confirm this?

Anyone have any tips for court, etc? Thanks!

I agree with this philosophy. 99% of tickets are paid through the mail. Cops hate appearing in court and often don't remember the stops. I've avoided at least 3 tickets this way. Cops don't remember. I've even thrown myself on the mercy of the court and gotten off scott free (who is scott anywayz). Go to court, request a trial, the DA will want to get you off his calendar!!

If you go to court and the cop claims that he is trained to make an estimate on speed, ask him the following questions:

1. Where his training was done?
2. Was his training done while stationary or while in motion?
3. Ask him what is margin for error was determined to be as a result of his training.

And here's the kicker:

4. Ask him for written proof of his training certification

This should help you in the courts eyes if he can't produce proof that he's qualified to make an estimate of speed.

I doubt very much that a park ranger is trained to estimate speed. They only usually do this for state troopers and highway patrol officers.

If you want to fight it and win, then tape the ticket to a board, get out an axe, and go to town.

No more speeding ticket!

You have to still pay it though.
 
By pace? how do you think they did it before radar?

It sounds like you were going to fast in the park, the park needs money, so they hand out tickets, you were going to fast and now you will have to pay 🙂

And remember you never know when some lil kid might jump out in front of you in a state park unless you work the door all day how would you know it was completely empty?

I hope you learn your lesson but not be punished to bad.
