GOP bill would make it even harder to sue police for misconduct

Keeping with the Trump administration’s law-and-order rhetoric, Republicans in the House and Senate recently introduced a bill they’re calling the Back the Blue Act of 2017. The Senate bill was introduced by John Cornyn (R-Tex.), and is co-sponsored by 15 senators, all Republicans. The identical House bill was introduced by Ted Poe (R-Tex.), and includes five co-sponsors, also all Republicans. The bill would create new federal crimes, impose federal police over the will of local officials and voters and shield police officers from virtually any civil liability, even in cases of egregious misconduct.

But perhaps the most disturbing part of the bill is the new restrictions it puts on suing police officers for constitutional violations. As we’ve discussed here several times before, it’s already extremely difficult to even get in front of a jury with a claim against law enforcement, much less win an award. Police officers are protected by qualified immunity, which requires you to show that not only were your rights violated but also a reasonable police officer should have known that the actions in question were a violation of the Constitution. Under this bill, even if you can show all of that, if the police can show that the violation and resulting injuries were “incurred in the course of, or as a result of, or . . . related to, conduct by the injured party that, more likely than not, constituted a felony or a crime of violence . . . (including any deprivation in the course of arrest or apprehension for, or the investigation, prosecution, or adjudication of, such an offense),” then the officers are liable only for out-of-pocket expenses. What’s more, the bill would bar plaintiffs from recovering attorneys fees in such cases.

What a ridiculous bill for them to propose. The police don't need even more legal shielding to protect them from civil lawsuits when they commit misconduct.

Well, Trump did say he would restore law & order. Sessions said that consent decrees imposed on abusive rogue cop shops were bad for morale. Congress is down for the program, obviously.

What could go wrong?

This law is already de-facto in place, it is already nigh impossible to charge a police officer with anything. Even with video evidence you will be lucky to get 1/3rd the sentence a normal pleb would get for murder or rape. For anything less significant than rape, Police are basically already 100% immune.


So let them have their masturbatory legislation, who cares? The world is already the way they want it.

Arguments against hate crime laws stating that "We don't need special laws to protect blacks or religious minorities or women or LGBT because there are already laws on the books concerning murder, assault etc etc etc" are usually from the mouths that say we need special laws concerning government officials.

Like Police, government employees that culturally operate outside of the laws they are tasked with enforcing while also having laws in place classifying them as a protected class that need additional protections.

It's easier to list the ones who are getting punished for shooting their fellow citizens.

A lot of police officers misuse their power and authority and when they do, they should be held accountable. Sorry to say, but in most cases, the police version usually is accepted as gospel.

There should never be any objection to holding our public officials accountable to the law. That the GOP wants to eliminate police accountability should be alarming to anyone, and we've seen recently how they hold their elected officials above the law.
