Going to jail....(Updated......no pics)

I got a ticket about 6 months ago (prior posting) for making a left turn during prohibited hours (7am to 9am). It was actually 6:55am when I made this turn. Anyways, I plead not guilty and had a court date set. I called and had that court date changed because I was going to be in Colorado for some computer training. They gave me a date of November 7th. On November 6th I called the court house to check on my court time, and was told that the charge was continued for dismissal. I got the ladies name that told me that, just in case. Two weeks later, I get a court date for December 26th. I called in and had to talk to Erika Cline, who does the scheduling. I first talked to Kimberly who was the one that told me that my case was dropped. I told her that I just recieved another court date in the mail and reminded her what she had said. Her reply "Sir, I just told you what showed up on my screen, it said continued for dismissal." I left several messages for Erika Cline and she finally called me back today. She told me that I now had a warrant out for my arrest, I could either turn myself in or they would come and get me. I asked her what the warrant was for and she told me "probation violation, chem dep" what ever that is. I told her that I have never been on probation, this was a mistake. Her reply was that she would not argue with me about this, I needed to turn myself in. I told her that Kimberly told me that it was continued for dismissal, she told me that I was lying and kimberly never told me that.
So, I have never been in trouble before in my life. Now at 40 yrs old, I have a warrant out for my arrest. I did not miss any court date, it is set for December 26th. I will have 7 years sobriety in 2 days, yet a warrant is out for my arrest for a chemical test failure or something. I called a lawyer and they want $500 to even talk to me about it. I dont have $500. Isnt this great, all of these years staying out of trouble and I am going to jail over a big mix up. I give............

I called my Sgt. and he did a warrant check and told me that there was no warrant. He then got a 3 way going with the traffic violations people. She found a warrant on a person with the same first and last name, different middle, different date of birth. This explains it all! Glad that I didnt pay a lawyer $500 to figure this out for me. My Sgt. said that he would definetely fight the ticket if it were him. December 26th, I will go to court!

If you have something in writing that says December 26th then you have nothing to worry about. Just show up then.

Sounds like the judicial system at its finest again.... Morons.

WOw... I am in no position to give any advice (since i dont know jack about law) but seems like it was their mistake from what you have told us so far.
Isnt there lawyers that work for you for free but get chunk of money that you win? maybe you need to get one of those but i highly suggest you get yourself a lawyer.

I think there are some AT member that practice law, they should be able to give you better advice.

hope everything works out ...

this is really disgusting the way they screw up and now they have a warrant ... :disgust:

Can you borrow money for a lawyer?
You definitely need to turn yourself in soon. You don't want to be a fugitive over some stupid misunderstanding. I am sure that the whole situation will be sorted out, and you will be out in no time. Just in case talk to your friends about borrowing money or bailing you out.

Sounds like a case of mistaken identity.

You should call the police and check with them. Stop talking to the courthouse people they are just employees and couldn't give a flying fvck if you got the chair for that moving violation. You don't need a lawyer you just need to talk to the police and get the warrant thing straightened out and then go down to the courthouse (plan on spending a whole day there) and find out what you have to do to resolve the ticket.

Call the police first. If you show up at the courthouse and they still think there's a warrant they will arrest you and take you to a cop station first no questions asked. When you talk to the police get the name of someone who will corroborate your lack of warrant so if the courthouse gives you a hard time you can call that person. Don't get mad, they aren't punishing you it's the way a beuracracy works. They don't make small mistakes, when they make them they're big.

I once had a 7,000 dollar fine that was for a guy with the same name. It took a long time to straighten out.....

there are also lawyers you can talk to out there for less then $500 for legal advice, but as for representing you, $500 the cheapest besides for appointed attorneys

dont even worry bout a laywer. the warrent is most likely just a default warrent. you can go in, they will set a date and youll leave.

that really sucks! :disgust: i think your best option is try and contact kimberly again then gather all the info and papers you have then go and try to clear this up. lloks like someone dropped the ball on this one.

sounds very strange to me. how do you go from a moving violation to a probation violation? sounds as if they're talking about a different person with perhaps the same or similar name. if i were in your shoes, i wouldn't do anything about turning yourself in. i'd show up on the court date for your traffic ticket and deal with that. if anything more comes up such as this mistaken probation violation, you won't be in any worse trouble than you already are and you'll get your court appointed attorney.

most likely this is perhaps some stupid mistake resulting from your trying to contact this EriKa person who has you confused with someone else. in the meantime, if there is a warrant actually out for you, they should know where to find you, don't go looking for them.

Cops can be jerks, my advice get a lawyer. Sure, the court will appoint you one, but you might have to sit your ass in prison for a couple days before they can even talk to you. Public defenders are so busy they usuallt take a few days to see you. This occured to a friend of mine, who was charged with aggravated assault (wrongly accused mind you.) It took him three days sitting in the clink before the public defender spoke to him, then 6 days before his trial which was immediately thrown out.

I talked to a lawyer again, he said "oh, you have a probation violation. I can get you out of that." I said LISTEN TO ME, I have never been in trouble before, ever. How can I have a probation violation when I have never been in trouble? I asked Erika at the attorneys office if she knew who she was talking to? I said this is a traffic offense, thats it. I havent missed a court date, I havent even talked to anyone yet. How can you have a warrant out for me? Her reply was "Sir, Im not going to argue with you about it."
Wanna here something funny? I am a volunteer for the St. Paul Police Department! I am a neighborhood assistance officer. I had to have a thorough background check! I drive the St. Paul Squad cars! I have I.D. to get into the PD. I dont want to spend ANY time in jail, so I am not going to "go down there and turn myself in until they get it straightend out". I have made many decisions, that have kept my ass out of jail. I am not going in over "there mistake".
I will just wait and go to court, alone, on the 26th of December. This is nuts. I should put my uniform on and go turn myself in.

This sucks man. Do you know anyone that's friends with a lawyer? I had wrong info placed on my file before. I had to fax a copy of the inacurrate info the the RMV in my state, along with a letter from the clerk saying that I shouldn't have a suspended license for shoplifting. (I think the person was a kid, and therefore lost his license.) Have you tried calling the police? I don't know what the laws in your state are, but I would think that after it gets straightened out, you could get the state to cover the legal fees...
