GM settles piracy dispute with Chinese automaker

DETROIT - General Motors Corp. said Friday it has reached a settlement resolving all legal disputes with Chinese automaker Chery Automobile Co.

GM had accused Chery of pirating the design of its Spark minicar, which looks similar to the Chery QQ, and had filed lawsuits trying to prevent Chery from selling the car in various markets, including Asia and Eastern Europe.

GM also had threatened legal action against Chery because of its name. GM says "Chery" sounds too much like "Chevy," the nickname of its Chevrolet brand. Chery agreed in September that it won't market its vehicles under the Chery name in the United States.

Under the settlement, GM and Chery won't take further legal action against each other. Further details of the settlement weren't released. GM said the two automakers will concentrate on developing their separate businesses.

"All parties highly appreciate the efforts that have been made by relevant governmental authorities for the purpose of further clarifying the intellectual property rights issue and relevant legal frameworks," GM said in a statement.

GM obtained the Spark design in 2002 when it acquired South Korea's Daewoo Motor Sales Corp. In September, China's State Intellectual Property Office determined the Spark design was never patented in China and wasn't protected by China's intellectual property laws.

GM and Chery are two of the biggest players in the Chinese market. Five Chery models are expected to arrive in the U.S. market in the summer of 2007, according to New York-based Visionary Vehicles, which plans to market Chery vehicles in the United States. http://www.detnews.com/2005/autosinsider/0511/18/0auto-386601.htm

yay for chinese automaker theives! It doens't help that the Chinese government encourages their domestic companies to steal.

You don't have to be right, or even have a valid case to sue some one. You just have to have enough lawyers and money to make them go bankrupt trying to defend against your outrageous claims.

a) chery is probably backed by the chinese government and isn't likely to go bankrupt
b) this is a pretty good claim. marketing under something that is similar to the trademark of someone in that industry is illegal under the trademark laws. if very similar you'll get an injunction against you. if only passingly similar then you might not. chery probably isn't pronounced like cherry, and don't forget to put the proper accent on it.

You know, ever since I heard about these "Chery" cars however long ago, I couldn't read any article without my mind seeing "Chevy" everytime "Chery" was written.

I thought I was just deranged because no one else ever commented on that. Glad to see someone else thought the same thing. It was probably intentional on their part anyway (Like Somy DVD players)
