If he attempted to stop such, it would add legitimacy to the list itself.
That he does not want to do; admit that the NSA under his watch/orders broke more constitutional laws.

Agree with you. And unfortunately I doubt the next President will stop it either, no matter which party they hail from. Modern politicians are terrified of anything bad happening on their watch as if the government should be omnipotent. So they'll turn us into a police state in hopes of preventing a relative handful of people dying of terrorism or some other random but relatively rare event that's largely unpreventable in any event. But the political imperative is always "DO SOMETHING!"
