Girlfriend got hit my uninsured motorist...options?

My girlfriend was driving on a street while a some guy made a left on a red and hit her backside of her corolla. He doesn't have any insurance or doesn't want to go through insurance to handle this. She doesn't have collision, but one of her step dads is a manchanic that'll fix it for free, but he's waiting for the guy to pay up.

The man that hit her is now asking for > 1 estimate and wasting time it seems. While shes driving around with a messed up side of her car. Her other step dad is getting ready to sue him if he doesn't come forth with the money. I just want her to get her ****** fixed ASAP so her tire doesn't blow up on her. Can she do anything through insurance to speed up this process? She doesn't want to fix it until the guy pays up. Shouldn't his insurance cover the damage if he has it? Can't she just report his license plate to her company and they can track him down?

Suggestions???
 
if he dosen't pay insurance, he probably won't pay to fix her car.

it's time to get the police/legal system involved with it. You can try one last letter explaining the situation but then you're looking at a civil court.
 
i am assuming you don't live in a no-fault state, right?
edit.. i see CA is not a no-fault state
 
She should be paying the minimal extra for "uninsured/underinsured" on her policy for just this purpose. If she is, use it and see if her insurance company will go after the other driver themselves.

you should get insurance involved. she has insurance, the other guy doesn't. she has every right to sue him regardless if she has collision or not.

Yep. Report it to the insurance company if you've got the coverage, otherwise you're stuck in a crappy situation, and need to call the police. However they probably can't do much at this point because you've waited too long.

edit: Actually, you're basically screwed because you don't have collision. Kiss it good bye.
 
seriously in any collision, police shoud be involved at the scene of the crash, insured or not. why didnt she call the police? It's a basic thnig stressed in any decent or crappy drivers ed calss. If she didnt call the police, it's probably too late now and she's SOL.

I have Liability only on my 94 Altima, plus Uninsured/Underinsured. It covers Bodily Injury 100K/300K plus Property Damage 100K.

How is this unreasonable????????? Get a quote from somewhere and then have her step dad make a quote lower. Once he pays up, she pockets the money and has it repaired.
 
First things first - she is legally obliged to tell her insurance company about the crash. This is the case whether she is going to make a claim or not.

While she is on the phone with her insurers, she should ask for their advice. It may be that she has legal assistance coverage - where the insurance will pay for expert legal advice.

Personally, if someone hit me, I would go straight to my insurers with their details. I get my car fixed the same week, and the insurers do all the chasing. If they were uninsured, then my insurers would pay the legal fees to sue him personally.
 
If he wants you to help him break the law, he must play by your rules, which means, he pays the amount whatever estimate you give him. If he doesn't want to, then you file a police report.
