She's retarded for falling into the fountain and for suing the mall.

The security guard who posted the video is retarded.

She should not only lose the case, but be forced to pay the legal expenses for the mall.

The mall should fire that security guard that posted the video online.

What an idiot, I certainly wouldn't have come forward... Kind of funny, though, because I figured it would be a younger girl (teens or 20s), not a middle aged woman. Just goes to show how little you could really make out from the video.

edit: I don't see how the argument about them not checking on her carries any weight. She obviously wasn't knocked unconscious and got out of the fountain pretty quick. And the janitor or whoever witnessed this was there to make sure she was OK. It's not like they needed to send a security guard there, things seemed to be under control.

Now obviously if she fell in and wasn't getting back up, or if she seemed woozy/disoriented after getting up like she had received a concussion or something, then I'm sure the security personnel would have reacted appropriately. But that wasn't the case, this was a harmless gaffe, so laughter and posting the video on YouTube seems appropriate enough.

well, it's also the type of belief and understanding that leads a population to accept 24hr CCTV surveillance over all citizens.

we spend enough time here bitching about the UK and their anti-privacy laws.

That's the kind of argument that supports the practice.

The difference is rightful mistrust of the government. The government shouldn't be conducting surveillance of the population. They have much more power than a mall or a bank does, and their power needs to be limited. I couldn't care less about someone filming me with their phone, or random cameras in stores, but I have a big problem when it's the government doing it.

What a dumbass. Falling into a fountain... okay that's a stupid mistake but it's kind of funny. I've walked into a lamp post a few times while messing with my phone. It's stupid but funny.

But suing? OMG. Because they didn't send staff to check on her right away even when she visibly got up fine and walked away?

Since video is being used to back up the allegations of these lawsuit hungry idiots the judges and juries are going to start looking at the accusers more carefully. They are being asked to pass judgment when the video evidence can cut either way. Just wait for the courts to start asking service providers to document cell phone and text message usage that timestamps exactly during the incident.

What a dumb ass. It is amazing what people can sue for in this damn country. If i was a judge id laugh at her also and dismiss the case.

I fail to see a way that this could not end badly and expensively for the subject of the video. Unless that is some reject is libelous.

I see no expectation of privacy.
I see nothing protraying her in a poor light.
I see no reason why we shouldn't laugh our asses off.

The mall has no reason to do so. The security guards are not a private medical force. If they knew about a dangerous situation and failed to do anything about it, then I can see a bit of cash for neglect, BUT this would be hush money at best. As stated, it looks like a mallworker immediately checked on her condition so thats out the door too.

I have text disabled on my phone.

Me also, coworkers say im nuts and accuse me of being "old" and Im only 28. I just call someone or email them if i want to communicate with them. This txt bullshit is just insane, kids texting each other while sitting right next to each other, all the while cell companies are laughing all the way to the bank

I seen the ABC news interview with her and she started choking back tears on there too. Although right before that they showed the cctv footage of her toppling over into the fountain so when they cut back to her crying you could still hear the laughs from the people on the cctv footage in the background. I LOL'd at her again.

If this dumbass gets anything more than laughed out of court and charged for the court fees, I'll lose any remaining hope I had for the justice system.
