gigabyte GA 965p ds3 problem

regarding my cd and dvd player running at pio mode on this motherboard.
I have found that if running my hard drives in either sata or raid, my cd will only run in PIO mode. If the SATA drives are run as IDE, then the cd runs in DMA 4 mode, but the HDD only runs at DMA 5. I have to select under the bios under" onboard sata/ide ctrl mode" to ide. this is the only way i can get the cd to run in dma mode.
This must be a flaw in the board, as i bought it to run two SATA drives in RAID.
Doing so however gives the above problem. RE installed XP and did express install. Same problem.
any 9ideas pls

From what I understand from my research on this board is that the RAID controller is flaky. It's just the way many 965 boards are acting that use this controller.
