GF had car accident...

OK about 3-4 weeks ago my gf got into a car accident.

A guy didn't stop at a stop sign and hit her in her backdoor/trunk area, the car was a totaled and her laptop and my poker chips(Paulsons BABY!) were both busted (they were in the trunk).

Now the insurance ppl wanted us to go get price quotes for each items witch me did. Then they called us and said we needed to go to a computer store and get a written piece of paper that said that the laptop was toast, witch we did... (50$ later).

Now they called back and said they want receipt for both items witch we don't have (laptop was a gift, and i got my poker chips on eBay)

What can i do? Any tips? My gf has yet to receive a check and she is in the middle of her exams at U and cant use her laptop cause its busted..
Please any help would be greatly appreciated.

thats what i told my gf to say but they want receipts... My brother in law got into a car accident and they replaced everythign without even asking for price quotes/ receipts...

This has been limping along for 4 weeks now.. im so pissed

The laptop is a gift, tell them that.

How long ago did you get your chips? How did you pay for em? Maybe the auction is still on ebay or the paypal transaction is still there.

And i think im gona have problems getting my pokerchips replaced, there Paulsons, there like 500$ for 500 chip case and my case was a 1000 chip case. There like 900$ on ebay...

I told her to tell them we dont have receipts, i think il need to talk to the insurance broker myself.

Do you have the eBay auction saved? That should be proof of what you paid. How did you pay of the chips? Paypal? Money order?

Tell them to STFU and give you YOUR money.

I hate insurance companies... :| they take and take and take and you NEVER get your money back when you are in an accident. They just royally screw you over.

Be a hard@ss and don't put up with their sh!t.

They should give you the replacement costs of the items, not just reimbursing what you paid for them in the first place.

acole1 get this, the lady even told my gf that since her laptop and my chips were about 1 year old that the price would need to reflect wear and tear... thus being cheaper then what they should be worth

well the laptop is what it is worth now, not then. But the poker chips don't really lose value like that (maybe a little) but they should pay whatever it costs to replace them with identical or an equivalent (read SAME if not better, NOT WORSE) item.

The guy's insurance company is just trying to give you the short end of the stick. Don't put up with it, press total replacement of the stuff and don't settle for any less than equal of what you lost.

once you mention that you'll get a lawyer to get the value of your items back, they usually pay up.

i once had a ceiling from a rental apt fall on all my belongings. management wanted receipts. i told them fine, i'll hire a lawyer and they will contact you.
they said nevermind, just buy whatever needs to be replaced and give us the receipts. they paid me a week later.

Are you dealing with your girlfriend's insurance co. or the other driver's insurance? You may need to get your company involved...

I would simply ask the lady "What do I need to do to get you to cover the liablility of your insured? Call the Insurance Commission?" This seems to scare the heck out of Insurance companies. Also remember that the person who hit you is Responsible for the damage and just because an Insurance Company wants to intimidate you does not mean that he/she is no longer liable for the damages. They CANNOT dicate what they will pay. If the policy does not cover the damages, he/she is responsible for the rest.
