I see alot of people optimizing their ATI video cards to get the most out of it. Some people getting thier 9500 to perform like 9700's

hmmmm

Isnt this the same thing Nvidia is doing with their drivers? They are getting the most out of the video card? They are not sacrificing quality. They are finding ways to get the most out of the card.

if you are referring to the 3dmark cheating u need to reread the article to see what is meant by 'cheating'. i don't even see how you can compare the two.

Short answer: no, not at all. ATI users (not ATI itself) are essentially doing a high-tech version of "overclocking" to get more out of their own GFX cards (modding a 9500 to 9700, for example). The speed they get from these (somewhat) risky modifications is not reflected in reviews. Nvidia, on the other hand, modified their drivers so that a particular benchmark was not rendered "fairly" - in other words, they changed things so that their cards would not have to do as much work to render the benchmark as their competitors' cards would, so in the end Nvidia gets a higher score in reviews.

If you can't see the difference, you are an incredibly blind person (possibly a nvidia fan?). Notice that I didn't defend ATI here; they have had their cheating fiasco as well. However, Nvidia is not above fault, and they did wrong this time.
