In her lawsuit, Thode alleges she was given a 0 in classroom participation, thus earning her the C+, because the teacher didn't like that she advocated for gay and lesbian rights.


However, Lehigh's attorneys are claiming that isn't true since the teacher has a family member who is a lesbian, The Morning Call reported.

Whoops, backfire.

Who cares. It will be next to impossible to prove that the students grade was a result of the teachers homophobia.

Now if no one in the class will stand up and say Student A was there and participated then it will be back to the student who looks like a nut.

Thats more of a dean thing, not a court thing.

Anyway, considerng she must have the easiest workload ever in order to even care she got a C, I wonder how much this actually effects her.

Yes.
If the participation part had been anything but zero the teacher and school would have a much easier defense. Giving a zero turns it around since if the student can show they showed up and participated then the teacher and school would have to show her participation was so bad it deserved such a low grade.

Just saying something doesn't constitute actually participating. The professor could easily stipulate that participation means constructive additions to the discussion.

Just another idiot who thinks she's entitled. Don't like your grade? Sue the school, it must be someone elses fault that you're an idiot. :rolleyes:

Well, we don't know the range. Was it 0-10 or 0-3, etc.
We also don't know how often the teacher gave people a 0.

This case could be valid if the teacher did use his personal bias in basing his grade.

It would be interesting if it were a Christian who was claiming the teacher was biased against Christians.

Not really enough to go on in the article. So, interestingly, people are bringing THEIR bias to this thread in what they THINK happened.

If a teacher uses personal bias to give a student a grade they don't deserve than a student has a clear right, imo, to contest the grade.

Why are people so quick to write off the student as blaming someone else? Class participation grading is an arbitrary value in the first place. But to give someone a 0? That means she either never showed up for class, never said a word in class, or whatever she contributed had no relevancy to the discussions at hand. Depending on the caliber of student she was, that may or may not be believable.

I'm not surprised. As college cost continue to outpace inflation, state support continues to drop, grants vanish, and students end up with ridiculous debt burdens* and low employment prospects we can expect more colleges to get their butts sued over stupid stuff as students and alumni try alternate means of debt relief.



* Yes, I know that in this case the student got a free ride.

I keed I keed. But seriously, this generation does suck. Coincides with the liberal voting though, so no surprise.

This generation of students got hosed by older generations and they are trying to figure out how to recover.
