Actually, it doesn't work either way...the situations aren't the same except for being able to broadly be categorized as actions protected under the 1st amendment.

As far as I can tell, nobody is claiming this action isn't protected by the Constitution, the argument is about whether it's offensive and/or a good idea or not. And being that burning another religion's holy book is not the same thing as building a community center near the former WTC site, it's understandable that people would be offended by one and not the other.

In other words, attempts to treat the two situations as the same are pretty transparently political, and pretty stupid to boot.
