Soooo pissed.

So I'm in the left turn lane and I realise that I need to turn right. Keep in mind this is at a red light, so I signal and someone lets me in and I turn right. 20 yards down the road I look in my rear-view to see a white unmarked car with it's lights on, "It's all good, what did I do, he's probably trying to get past me" is what I think as I move to the side of the road, as he follows I realise "no f-ing dice" so I turn into the first parking lot.

I kill my car, turn down the radio, roll down my window and put my hands on the dash waiting for the officer. "I pulled you over because you took a right turn from a left lane". WTF?!? That doesn't even make any sense. "You see officer, I'm in a big rush and I'm not familar with the city and I had to get over". "Let me see your license and registration "is all he says. "But"... I'm left with words in my mouth as he walks away to his car. He comes back 10 minutes later with a ticket for $135. :|

At this point I realise that I can't do jack and accept it and drive off.

There are a few points of interest:
I can't make out what the actual charge is on the ticket, I know what he told me "taking a right turn from a left turn only lane" but I can't imagine that anybody else will be able to make the offense out. I plan on contesting this charge in court, hoping that he won't show up or that I'll be able to explain my side to a judge, but if nobody can tell what the charge is and the cop doesn't show up do I get out of it?
Also, I know that this is a hit or miss thing, but he did say that I was pulled in the PM when I was pulled in the AM. If I was somehow able to prove that I wasn't in my car this evening at that time would I be able to get out of it?

Now I'm all for accepting responsiblity for my actions and if I had done something that I actually thought was illegal I would have no problem manning up and eating the fine. I'm really pissed that the cop didn't even listen to what I had to say. Of course I saw a cop every mile and there were many people on the side of the road having been pulled. I guess it's time to start the new year off with some new money for the city. :roll:

Even if I don't get out of it what are my chances of having the charge reduced and if not what kind of points am I looking at for my insurance, if any?

Cause I can understand the latter, but if you turned from the left lane, just pay the ticket.

Making a right turn in a left turn only lane is not only illegal, it is also very dangerous.

I moved into the right lane with signal.

And then from the right lane, you turned right onto the next street?

I dont see the problem with that. Hell, I've only been driving for a few months and I've done that even with my driving instructor.

your state's point schedule is available online. If this happened in another state, the points will still be assigned by your home state's schedule IF it even comes over (and it seldom does).

Here is what you need to do:
1) Plead not guilty by mail
2) find your nearest notary... you'll be using it a lot.
3) request trial by affadavit
4) file motion for discovery of officer's notes
5) get in touch with the DA via phone and see what he'll offer you in exchange for you just capitulating now (pleading down)
6) if you don't like that, go to court. If you don't get the officers notes in a timley fashion, the case should be thrown out on its ear
7) else the state's case should fall apart on its own when it's realized how absurd the original situation is and you've got a 30-40% chance of the judge tossing it.

Did you make the right AT the intersection (stupid crap in the intersection) or did you get into the right turn lane before the intersection (illegal lane change). You only have a fighting chance at number 7 if it was the latter because the previous is retarded on your part.

"Left-turn only" means: don't go straight or turn right. I don't think it means that you can't change out of the lane.:roll: Maybe someone could clarify this.

Cutting perpendicular across lanes to get from the right to left, or left to right is pretty dangerous regardless of what the law states. In all likelihood, if it's a left turn only lane, you can signal to get out of it, but not cut completely across the other lanes like you did.

Also, there are officially no quotas, and even if there were, they normally don't start off the beginning of a month nailing people with tickets. It's normally towards the end of the month where you see a rise in tickets.

I can't make out what the actual charge is on the ticket, I know what he told me "taking a right turn from a left turn only lane" but I can't imagine that anybody else will be able to make the offense out. I plan on contesting this charge in court, hoping that he won't show up or that I'll be able to explain my side to a judge, but if nobody can tell what the charge is and the cop doesn't show up do I get out of it?
Also, I know that this is a hit or miss thing, but he did say that I was pulled in the PM when I was pulled in the AM. If I was somehow able to prove that I wasn't in my car this evening at that time would I be able to get out of it?

Now I'm all for accepting responsiblity for my actions and if I had done something that I actually thought was illegal I would have no problem manning up and eating the fine. I'm really pissed that the cop didn't even listen to what I had to say. Of course I saw a cop every mile and there were many people on the side of the road having been pulled. I guess it's time to start the new year off with some new money for the city. :roll:

Even if I don't get out of it what are my chances of having the charge reduced and if not what kind of points am I looking at for my insurance, if any?

Indeed. I'd be very currious to see if changing out of a "left turn only" lane is illegal.

First, read the thread. Second, there may not be quota's but I know cops and they get pressure put on them if they are an "underperforming" officer. What the hell do you think that means?

Anyway, that's fvcking weak, but thats what the pigs do. I don't know what chance you have at fighting it but if the ticket would really hurt you, I suppose you can try.

how many cars, if any, were you back from the light? was the light green or red when you switched lanes and turned? did the person letting you over cause traffic to be held up? did you have to turn immediately after you were let into the right lane?

if you were the first, or one of the front few, and it held up traffic in the right lane to let you over then i can see where the cop gave you a ticket. a little anal maybe, but holding up traffic when a light is green isnt very safe.

you really need to draw a diagram to explain yourself better.

I DID NOT TURN RIGHT FROM THE LEFT LANE. I CHANGED LANGES AND THEN TURNED. THE ONLY NEGOTIATION FROM THE "LEFT TURN ONLY" LANE WAS A LANE CHANGE!
