Was having a conversation and this came up.

If you had a "joint and survivor pension set up"

What if an old man's wife died, and that old man had a good pension. He could then marry his daughter's fiance. And when he dies, the new "husband" collects the pension of the spouse right?

Then the young man proceeds to marry the daughter, and continue to collect the pension?

Or is there built in blocks for this already?

Just curious. I admit to being completely ignorant of any of the underlying rules

It could have a provision regarding spouses with an age difference of 10+ years. You'd run into the same issue with old men and young wives.

The fact that people still generally consider marriage to be more than a simple business contract tends to prevent this being a real problem.

Sorry, I am not trying to vilify gay marriage. It just came up in a discussion a person I know had with another person. They are both over 60 but where joking about it. And the story got relayed to me.

Basically went: "So if your wife died, you and I could get married, and then if you died, I could collect your pension right?"

Anyways, so I thought I would ask it here, and see what you guys all thought.

Gender doesn't matter in the described scenario. The guy could marry his son's fiancee instead... who that person marries if the pensioner passes away is immaterial.

It's all entirely plausible.

Even with same age marriage partners, pension benefits are usually reduced to half for a surviving spouse, with greater reductions for age differentials.

The vast majority of Americans working today will receive no pensions- they'll be lucky to get enough SS to live more than meager lifestyles, and their 401K's & similar will be looted in an ongoing fashion by the administrators of various funds in which they're invested, not to mention the actions of Wall St.

So, uhh, vote Republican, give 'em another tax break- it's like feeding the bears...

Wasn't there something about rich older guys adopting their younger girlfriends for similar reasons?

Back in the 1980s, there were a few widows who were still collecting *Civil War* pensions. Actually, after a quick googling, as of Feb this year, there were still 2 people receiving civil war pensions. 147 years after the Civil War!!

You question has nothing to do with "gay" marriage, it could have been a father and his son's fiance. FYI most pensions have rules to stop what you are saying, actuarial adjustment for ages and you having to be married to the person PRIOR to retirement.
