Gateway just backed out on an order I placed, can they do that?

I got this email message

Thank you for ordering from Gateway. We have received and processed your order. When we ship that order, we will send you another e-mail confirmation.

Order status: Your Gateway order has been placed and is currently being processed. Your estimated arrival date is 02/24/2003.

Order number: XXXXXXXXXXXXXXX
Ship to address:

a week later after asking if my item has been shipped yet i get this:

Thank you for your order on Gateway.com

Unfortunately, your order for the Canon S-30 Digital Camera cannot be
fulfilled due to inventory levels.

We are sincerely sorry for this.

We would like to help you get into a camera that we do currently have in
stock.

And they listed cameras they had in stock, none of which I am interested in except the S45, but not at that price they were asking.

So am I totally out in the cold here? It was in stock when I ordered, they processed it and even gave me an ETA on when it would be at my doorstep, 1 day before its supposed to be here I get this email?

ok, so im not TOTALLY outraged, but I could have simply bought this elsewhere for the same price (minus the free flash card) and had it a dang week ago!

Yes they can do that. You ordered a camera that they don't have, how the hell are they supposed to sell it to you?

They claimed they had it at the time, and gave me confirmation of my order? btw, thanks for the attitude

It said "in stock, ships in 1-2 days" when I ordered. They gave me a confirmation email, said it would be arriving approximately such and such a time.

I held off getting it because of that, and yes, I expect a company who claims something to be "in stock" to have it in stock, and a company who "confirms my order" to mean that they have my little order confirmed and be able to ship it.

I believe unless they charged your credit card, there was nothing binding them to the transaction.

Do you really think if Gateway had the camera, they wouldn't give it to you? Last I checked, they were a business out to make money, not to build your hopes up and cancel your order at the last second...

Sh!t happens. At the time you placed the order Gateway was probably expecting to recieve a shipment from their distributer, but something probably got messed up. I work at Gateway Country, and we were supposed to have a shipment of the same digital cameras come in last week, but the shipment was cancelled to the store too.

Just so everyone knows, I know Gateway isn't out to get me. I'm just a little upset that they didn't know they were out of stock of it before letting me place the order and wait a week. I held off on getting it last week because I was opting out for the extra 128 CF. Maybe that makes me greedy, but now I've waited an entire week with nothing to show for it. *and yes, I could have been using it this current week =)*

Put it in perspective. If you had to wait 1 week and then finally heard that your "motherboard" or "cpu" was out of stock and you have to order elsewhere, from some online dealer, you would be a little set back as well.

Do you have a Gateway Country store near you? I believe that they should be running the same special with the free card, so check it out.

aye, I figured it was something like that after I got the email. I would have taken one of their remaining few in stock though =)

most of these things are dropped shipped and the distributor is told by the manufacturer that they'll have x number available so the distributor tells the retailer that they'll have x number so they'll say that they're in stock and ready to ship and they'll say that until the distributor's system tells them its out of stock. well, often theres more orders in the queue at the retailer than the distributor can fill, because all those systems aren't linked together very well.
