Hey, remember the free Deus Ex: Human Revolution OnLive code that comes with the retail PC version? If you bought your copy at GameStop, chances are you didn't get the code. It turns out that the retailer decided not to participate in the promotion ... by force.

GameSpy is reporting that GameStop employees received notice yesterday that they were to open new PC copies of Deus Ex and remove the free OnLive token. To repeat: GameStop employees were told to open new copies and remove contents intended to be sold with the game.

A GameStop representative confirmed to GameSpy that the company is removing the tokens, saying, "Square Enix packed the competitor's coupon with our DXHR product without our prior knowledge and we did pull and discard these coupons." Indeed, some of our own commenters claiming to be GameStop employees said the same thing in our post revealing the OnLive promotion yesterday.

Joystiq is currently investigating the issue, including the possible legal implications of tampering with a product and selling it as new.

Buy your copy somewhere else and give Gamestop the good ol FU.

I wonder how many of those codes will end up on eBay or forums like the BST here on Anandtech. The store employees are most likely pocketing them.

I picked up my copy at GameStop yesterday, and it has the OnLive card inside - like normal, they took the DVD out of a sleeve, and put it in the case with the other items (new copy), but honestly I don't mind... I've never had a code being already used, nor have I gotten an obviously used disc.

I hope Eidos/Square and OnLive sue GameStop. This has got to breach something that they can nail them to the floor over.

No way. Will cancel my Skyrim, MW 3 and BF3 preorder from Gamestop ASAP. Don't want any of that being pulled on me. What is stopping them from doing it to these games? Nothing which means they get $0 from me. Nope

GameStop’s practice of removing a competitor’s coupons from new copies of videogames could land the retailer in legal hot water.

On Tuesday, GameStop’s corporate office sent a memo to employees, instructing them to open copies of new Square Enix game Deus Ex: Human Revolution and yank out the included coupon codes that let buyers play the title for free on OnLive, a digital distribution service and one of GameStop’s prime competitors. Employees were then told to sell the copies as if they were brand new.

GameStop representative Beth Sharum confirmed the policy, telling Wired.com in an e-mail that, “Square Enix packed the competitor’s coupon with our [Deus Ex: Human Revolution] product without our prior knowledge and we did pull these coupons.”

Though the new policy might seem outrageous to GameStop customers, lawyer and game industry analyst Mark Methenitis said it might not violate consumers’ rights, as OnLive coupons are not an “essential function” of the new game. However, Square Enix and OnLive “may have a claim against GameStop in terms of tortious interference,” Methenitis said in a phone interview with Wired.com.


Tortious interference litigation results when one party accuses another of intentionally damaging their business contracts or relationships. By removing OnLive’s coupon from copies of Deus Ex: Human Revolution, GameStop might have violated United States economic tort law.

Methenitis added that customers might be able to pursue legal action against GameStop for deceptive trade practices or fraudulent advertising, though he doesn’t think they’d have much of a case, as nothing on the game’s packaging suggests that it includes the OnLive code. He also said GameStop could be in the right if Square Enix had violated terms of a pre-existing agreement with the retailer.

“Existing contracts between GameStop and Square may have barred this kind of promotion, and so GameStop may actually be justified in their action if Square is in breach of some promotion/marketing agreement,” he said. GameStop did not immediately reply to Wired.com’s request for information on any pre-existing agreements with Square Enix.

When contacted by e-mail by Wired.com, a representative for Square Enix said, “We’re currently looking into it and have no comment for the time being.” A representative for OnLive also said the company had no comment at this time.

This isn’t the first time GameStop’s practices, particularly with regards to opened games that are then sold as new, have ruffled feathers. The company has been accused of deceptive practices several times over the past few years, particularly revolving around its “rental” program, which allows store employees to borrow inventoried games for up to four days. Many employees have reported playing new copies of games, then selling them to customers as if they had not been used.

The company has been hit by a class-action lawsuit over its practices.

Wired.com contacted several current and former GameStop employees over the past few months, with some confirming that their stores sold used copies of games as if they were new. Other employees reported that their stores were very strict about not allowing the “rental” of new copies of games.

“We are able to rent these games the day they come out,” said GameStop employee James Goshow in an e-mail to Wired.com. “We act like nothing has happened, like it wasn’t sitting in my Xbox for the last two weeks, like I didn’t drop it on the floor. When customers ask, ‘Why is my game not wrapped?’ we just reply, ‘Well, we have to put some of the new cases out on the floor, but that is new — don’t worry.’”

Some of GameStop’s policies might have violated Federal Trade Commission policy, though Methenitis said customers have not been successful in winning lawsuits against the retailer for selling used games as if they were new.

“The FTC Act prohibits unfair and deceptive business practices,” an FTC representative told Wired.com. “So if a company misrepresents that a product is new and doesn’t make adequate disclosures that it has been open or used, then that could be considered deceptive.”

I don't understand how this wouldn't violate users rights considering the product is not new if you open it, but that's besides the point. Wonder if this would make SE consider pulling it's games and distribution from GameStop?

Sadly, people still shop there (not necessarily for PC games, but it's sad either way). I was actually there a few weeks ago (don't judge me) and most of the people who shop there are ignorant console gaming peasants. I remember seeing a group of customers standing at the front counter, mouths hanging open, staring dumbfounded at the LCD television monitor that was playing an endless loop of two different Gamestop commercials. The advertisements basically said "Pre-order X game, and recieve X bonus weapon exclusively from Gamestop!" or, "Pre-order Y game, and recieve Y bonus skin exclusively from Gamestop! GAMESTOP, POWER TO THE PLAYERS."

Fun fact: As a publisher, if you want Gamestop to promote your new video game and accept pre-orders, you HAVE to make exclusive bonus content specifically for Gamestop. It's part of the contract. When Portal 2 was released, Valve basically trolled them by saying "Uhh, ok, if people pre-order from Gamestop then they get to have these ugly piss-colored crossbar decorations for their co-op characters." And gamestop actually accepted it.

Meanwhile, while I was standing in the store, some dude came in and was looking at all the posters, and he's like "Ohh! Gears of War 3!" and then he walked up to me and said "Hey bro, you into Gears of War?" and I responded "Ehh, no, not really my thing." Then he went up to the counter and asked "Can I pre-order Gears of War 3 please?"

I chuckled to myself. You actually pay a full $60 for your games? lol. I can't even remember the last time I had to pre-order a game in order to physically drive to a store and pick it up. What a joke.

So rediculous. Did anyone read Game Stop's rep's excuse? She said they pulled it because Square put in the voucher without Game Stop's permission. Ever since when did the manufacturer have to notify the store about a game they are selling? That's like Best Buy telling Kenmore they can't include a rebate with their washer/dryer.

I have absolutely no idea on console game market. When ever I go windows shopping in my local mall.. I see a bunch of teenagers looking at games. I thought GameStop was a decent place to buy console games after all.

Anyway, my earlier post reflects my knowledge of buying games at retail stores. :p

In the past I've been known to buy older used console games. Generally those are lower price than you can buy on or elsewhere..at least they used to be. I'd never buy new from there though.

I would be pocketing them if I was them. Work throughing out something of value is just wasting money to me. No conflict of interest was work values it at $0. Just because it does have a value to me does not mean I will not at least try to get something for it.

I don't pre-order games, not anymore after Halo 2 (I pre-ordered Halo 2 CE, and it turned out that Wal-Mart had a display case full of them on launch day).

I also don't pay full price for games because I'm a cheap ass, not because I can't afford them. I buy used games from Gamestop, at least 6 months after they've been released. I paid $35 for Red Dead Redemption and Uncharted 2: Among Thieves, used at Gamestop.

This is some sneaky bullshit, though. I hope they get into as much trouble as they can cause of this.
