From Namco's Website

I have a broken or scratched disc. How can I get a replacement?
If you purchased your game new from your retailer and discovered a broken or scratched disc when you first opened the jewel case, please return the game back to the retailer for an exchange. If you have a broken or scratched disc but the above does not apply to you, please refer to Namco's limited warranty policy information found in the back of your game manual.

I had the same problem with a scratched up Sims disc for gamecube and fixed it right up by using some plain old toothpaste (original white colgate, make sure there are no flavor crystals). Then I just rubbed the scratches in nice circular motions to help smooth out the dents with my fingers. About 10 minutes later, after cleaning up the mess with a paper towel, I popped the disc right back in and guess what...it works! =0

Which side is scratched? If it's the label side, you're screwed. If it's the other (shiny) side, it can probably be fixed (unless the scratch is really deep). BB (& probably CC) sell stuff for fixing scratched CDs and DVDs.

Its the data side, I will see what can be done with some of the products out that help repair scratched disc's.

Called up Namco today got an RMA issued,
so if everything goes well I should be getting a replacement in a week.

Fingers Crossed.

Did you have to ship your old disc to them or anything?

No, you can't backup GC discs. There is a way people pirate/"back up" GC games, but that's "bad". :)
