I hope he wins so I can't recovery all my loses from the Casinos then I would be able to retire today. ;)

I'm pretty sure the judge was assigned to the case, and the article doesn't say whether it went to trial so he could've granted a motion to dismiss
Alright... I'll let the judge go. But not the plaintiff's shyster. Get a rope! ;) :D

edit: on a serious note, I thought I'd point how this frivilous case, along with the similar frivilous cases against fast-food restaurants and tobacco companies, represent a serious threat to our governmental process. The purpose of the judicial branch in the US government was never to create (or legislate) laws, but that is exactly what is happening here. In fact, it's been given a name: tort legislation. Note who is backing the plaintiff - a lobbyist organization called the National Coalition Against Gambling Expansion. Being a group that is against gambling (and heavily funded by fundamentalist churches), they have been unsuccessful lately in fighting gambling through the state legislatures. So where do they turn? The courts and "tort legislation." And it's all textbook from the examples of the groups that fought the tobacco companies. Take a look. The state-funded anti-casino propagandas have already begun. Next, there will be new taxes specifically against casinos, which will be introduced by ballot measure, which voters will happily increase because the majority "don't go to the casinos." Thank God I live in free country that doesn't have a corrupt government!
