If that is assault and battery, then yes, it would be reflex. In his mind he was about to be jumped and on impulse acted to stop the threat. I never said that he should continue beating him and in my opinion, that would be grounds for a criminal case. All you have to do is see how he hesitates just a second too late and holds up his hands to show that he didn't intend to beat the hell out of him for scaring him.

Sounds like assault to me. And one other thing no matter how much you or anyone else in this thread wants to pretend, there is NOTHING funny about that video. So cut the crap on that baloney.

I won't speculate as to whether the video is a setup or not but I can say from experience, I have punched someone out of reflex. Normally, when I am startled (my brother used to pull crap like this on me all the time), I would seize up and scream like a girl and do nothing. In one situation, I was passing by a haunted house setup at a park and this dude jumps out at me. Without a second thought, I punched him directly in the chest. He fell backwards onto the ground and I immediately ran over and apologized. I felt terrible about it, and would never intentionally do something like that.

And no, I'm not a tough guy wannabe, and don't think it's cool to hit people. But I can say given the right circumstances, it is possible to strike someone out of reflex or instant reaction.

EDIT: I will also say in the video, it looks like he stops his punch on contact, which is pretty much what happened when I did this. It's like it took just one second to long for the brain to catch up to the instinct.

Even when the puncher was pretty much jumped? If he stopped after the first blow it's pretty obvious that he had no intentions of getting revenge or whatnot. This looks more like self-defense gone slightly wrong to me.

Er, the kid that got punched was stunned for at least a second before he fell down. If the jumpy guy was really just a violent person he would have had plenty of time to get one or two more swings in before the other one fell in.

No your right , cold-cocking (possibly permanently injuring) some kid playing a prank isn't violent. I was mistaken. I'm sure you would have reacted the same way.

Virtually everyone makes a violent action at some point in their life for self-defense, carelessness, or something else completely different from actively seeking out a person to commit violence against. He did not punch the kid solely because he was playing a prank. That case would be along the lines of where that car driver shot some kid for egging his car. The person in this video did it out of a split-second reaction and instinct for self-defense.

Baloney. I got eyes too . Don't tell me what i saw and how to interpret it. If you look close you will see that NOBODY laid a hand on him or his property, so it is NOT analogous to the egg incident you cited
