there is a lot of things that kids shouldnt be doing and therefore others have to take precautions because its obvious they will do it anyway

The problem is that they did not lie about their age:
allegedly permitted creation of 1.7 million accounts by users who submitted birthdays indicating they were under 13.

It would have been fine if they lied about being older than 13, the problem is that they didn't, and xanga allowed them to sign up.
