FTC Fines Diet Pill Makers for False Claims

WASHINGTON (Jan. 4) - The Federal Trade Commission on Thursday fined the marketers of four weight loss pills millions of dollars for making false advertising claims ranging from rapid weight loss to reducing the risk of cancer.

FTC Commissioner Deborah Platt Majoras said the products would remain on store shelves, but that the companies would have to stop making the false claims.

"What we challenge is the marketing of the claims," she said. "The marketers are required to back up the claims with the science and if they can't do that they can't make the claim. But we don't ban the products from the shelves."

The FTC investigated a variety of claims made - including rapid weight loss and reduction in the risk of osteoporosis, Alzheimer's and even cancer, Majoras noted.

Fines were levied against marketers of Xenadrine EFX, One A Day Weight Smart, Cortaslim and TrimSpa. Majoras did not specify how much each marketer was being fined and did not identify the marketers. The FTC scheduled a new conference later Thursday to announce details.

Efforts to reach the product manufacturers were not immediately successful.

Majoras said that some of the money paid as civil fines would be returned to consumers. "We always try to get money back when consumers have been deceived," she said. "In this instance I'm pleased to say that I believe we're going to get millions back from some of these products to be able to return it to consumers."

Majoras, speaking on NBC's "Today" show, said the FTC investigation found that the marketers of Xenadrine had a study that said those who took a placebo actually lost more weight than those taking the pill.

"They not only didn't have studies to support the claim, they actually had a study that went the other way," she said.

Some of the products marketed their claims through infomercials or celebrity endorsements. Anna Nicole Smith, for example, has endorsed TrimSpa.

"Testimonials from individuals are not a substitute for science," Majoras said. "And that's what Americans need to understand."

Thats a very interesting point but not at all what we are talking about here.

Concerning the topic at hand, I dont think EVERYTHING needs to go away from GNC, I like the protein stuff and the specialized vitamins.

There are plenty of supplements out there that work. Sometimes you have to go through some trial and error and you have to do a bit of research and reviews from what other consumers are saying about the product. Also, just because the product didnt work for you, that doesnt mean it does not work. For some people, certain supplements have no effect on them. Some people get nothing form creatine for example.

All of their stuff is overpriced. And they do not carry a good selection of products. Vitamin Shoppe has an excellent selection of products, but they too are overpriced.

I order from either bodybuilding.com, bulknutrition.com, or fitnessone.com

A tiny little part of me is happy, but overall I think that if you are stupid enough to think that a pill will fix your weight problems then you deserve to be out the $20, $30, $50 a month that you spent on them.

If they were doing this because of harmful side effects I'd feel better about it. But this is about a lack of actual function. Caveat emptor.

Well if money is what everyone is concerned about here let me remind you that Wal-Mart is cheaper than everyone.
I can get huge jugs of powdered choco protein for dirt cheap there. About 1/3 of GNC's price.

Yea, a buddy of mine was a member of the gold club at GNC. I've never really researched the memerbship program.

Besides their prices and their lack of a good selection of products, their customer service is ridiculous. Everytime I've been in a GNC, there's some skinny guy working trying to tell me that I need to buy this and that and take this if I want to get ripped. lol

Im not the god almighty supplement guru, but I read supplement reviews daily and Im pretty up-to-date with this stuff, and I've never heard of body fortress whey protein. Maybe most people just havent heard of it, but it's never mentioned.

dont tell me you buy that stuff from GNC. FitRx.com has it all for much cheaper. i usually get Optimum Nutrition products. Seems to work pretty well. Also recently got Glutamine powder...verdict is still is out on that

Again, if you use the gold club discount and catch a sale, GNC can often be cheaper than online stores. Even with just the discount, it's not all that much more after you figure shipping.

vitamin shoppe has good prices if you catch some of their sales. i've gotten stuff cheaper there than online before shipping.

Not very good whey. Optimum Nutrition Whey is some good stuff. And Biotest Metabolic Drive protein bars are delicious, and seem to be the best protein bars nutrition wise for lifting.
