Friend bought new car. Instant CEL

I'm not really sure how to advise them, still waiting on some more secondhand details.

Signed papers and started to drive off, and the AC didn't work, was told it was a software issue and new cars software was newer than the dealerships software, waiting on an update. Got a loaner, bitched a little and then got her car back in a few days.

Drove home, next week got a CEL, called back got another loaner and bitched more.

Had loaner for a week, got another, and another.

Was told it was emissions related but the car was newer than their systems and they were waiting on a tool that they didnt have.

She was offered a few months of payments or a new car, opted for the payments with the option of getting a new car anyway if it is a big problem.

Was called today and told it was a pinched oring, it has been replaced and they are test driving it now. Been a month since initial pick-up.






I'm nervous because the car came from the factory with this problem, but on the other hand a pinched oring can't really cause any damage if the car isn't being driven around.

So does she try to go through with a big fuss and get a different car or can they have peace of mind that it is fixed now? Current dilemma is that her dad has now told her 3 car payments wasn't enough and she needs to get a new car, and is stressing out about it.
 
Where do you live? In Ohio, 30 days out of service in the first year, even if it's just sitting at the dealer waiting for a part, is eligible for an automatic lemon law.
 
Probably a Mazda or Nissan.

New car lemon law
In Kentucky, manufacturers are required to repurchase an automobile if it is determined to be a "lemon." You can file a suit in a circuit court but you must first go through the manufacturer's arbitration system. To qualify as a lemon:

The automobile must have been purchased new in Kentucky by a Kentucky resident and not have more than two (2) axles and cannot be a motorcycle, motor home, conversion van, or farm equipment. New automobiles leased after July 15, 1998 are also covered.
The consumer must report the failure to repair the non-conformity to the manufacturer within the first 12 months or 12,000 miles, whichever is first.
The problem must substantially impair the use, value, or safety of the automobile.
The automobile has been out of service for the same problem for a cumulative total of 30 days or more or the problem was not corrected within a reasonable number of attempts. Four (4) attempts to repair the same problems is presumed to be reasonable.
 
My brother's Evo X had a dead o2 sensor the day he got it. He waited like 2 weeks and took it back, and they had it fixed in minutes.

In Ohio if you meet one of the automatic requirements, there really isn't any hassle. Talk to someone at the attorney general's office, fill out some paperwork, and that's it. If you have to argue your case at a hearing with the BBB or something, that's a different story, but if you're over the 30 days you shouldn't have to.

"Hose takes vapors off of fuel tank. That o ring was pinched and letting vapors out. Undid 6 clips, pulled plastic cover off and took hose off, put on new o-ring. Just to release vapors. "

I told her to enjoy the car and not to worry.

LOL, I wasn't spamming. I was considering what a young female would buy that her father would approve of, so I went with main stream brands.

Minis have terrible reputations for reliability.
 
My Mazda had the same little pinched AC o-ring issue from brand new. Just took it back, they fixed it and washed my car and I was happy. No need to get anyone else involved or sully JD power reputations.
Although that is wierd that BMW/Mini sell a car that they can't even fix. Sound lazy to me.

Its a new dealership and from what I can tell they were just incompetent. I think they were running down a diagnostic test sheet, and needed a tool they didn't own so it took them 3 weeks to get this figured out.

Car was delivered this evening, wouldn't let me drive it.

Did get to drive the first loaner, a clubman S

I was close, I was going to guess the gas cap o-ring. So it sounds like it was the purge canister? As much as I prefer domestic cars, it sounds more like you're dealing with an incompetent dealership than lemon car.

Mini's have pretty average to slightly above average reputations for reliability. They also have good resale value and most dealerships work hard to get any problems fixed.
 
Had to fix the evap system on my Maxima recently too... Dealer wants an arm and a leg for parts. I went to the wreckers and got some parts to fix it. No more CEL. Not that it would matter anyways for useless evap stuff. I just don't like looking at it. (the CEL)
