*FIX* Visiontek Xtasy 9600XT performance problems: AGP off, not 8x ~ not reading correct AGP, won't recognize AGP

Ahh. I bought this card and it does come with HL2. I don't think it's performing like it should. After checking the settings, under the smartgart tab, it shows my AGP as off. My motherboard supports 8x and when I try to set it that high, it prompts for restart. After I restart it sets back down to off =/.
In the manual it states that the irq should be 10 or ll, on mine it's 16. I dont' know what irq is and I dont' know how to change it. Would this be related?

I tried changing it under the bios (I'm not very knowledgeable) From what I can tell I can only assign irq for my PCI slots through my bios.(Pheonix-Award Bios). I did some sniffing around and found two things on the visiontek (company of xtasy) forums.
in the FAQ

1) It says that it's ok to have a irq higher than 15 as long as it's not sharing with WinXP. (mine is 16)

2)Problems with Visiontek serving the lifetime warranty. I personally did not find any warranty card in my box, nor could I find any info on their website. I have emailed them asking for the terms of their lifetime warranty.

If I can't resolve these issues I'm gonna try to return it at Comp USA B&M (without %15 restock) stating that there is no such lifetime in the box nor could I find info on the site.

*FIX*

I upgraded my albatron motherboard bios. (the updated version specifically sites helping fix problems with the 9500 pro) It still didn't work. After I updated my Via chipset drivers it worked. The irq still reads at 16 but this doesn't seem to make any difference even when it's shared (tried on my friends computer). This seems to be a common problem as you can see in the anandtech forums.
 
Ensure that fastwrites are disabled in your MB BIOS, then try setting AGP speed to 4x with SmartGART.
 
Yep, a few people had the same problem on Ars, and it turns out they hadn't installed their MB AGP drivers yet.
