Here's the answer I got from Robert Pearce, Corsair's Applications Specialist:

The problem is the chipset won't handle a tRCD (RAS to CAS Delay) of 2. We've done a revision of the SPD to make the LL's work on the 875 and 865 chipsets, the settings are now 2-3-2-6 by default.
We will, of course, warranty any modules with the older SPD but it should be noted that the end user can simply manually adjust the BIOS to the settings noted above
 
Interseting.

I had my TwinX512-3200LL running 100% stable at 2-2-2-5. Swapped it for a 1 gig via 2 x 512 XMS 3500 C2 and it would not boot at 2-2-2-5 even at DDR 333. Swapped that for TwinX1024-3200LL and it corrupts the BIOS if I try 2-2-2-5, 2-2-2-6 or 2-2-3-6. Pain in the ass reverting to the old BIOS so I am just running 2-3-3-7 for the time being (this is all at DDR 400).

I think I will switch back to the XMS 3500.
 
They should lower the price down a bit if its gonna be 2-3-2-6 and not the faster 2-2-2-6🙂.
