Hello people,

I was rear ended the other day. I was wondering do you guys recommend getting a lawyer or just handle it without a lawyer through the other party's insurance?

accident wasn't too bad...bumper damage and a whiplash... so stiffness of back and neck.

what would you guys advise me doing?

My insurance company said they're passing the case to the other insurance company. basically she told me that they're not going to handle it anymore, and she said she can't give me any consultation.

i feel bad to sue, i just want my part covered... medical bills and damages.

EDIT: If they passed the buck to the other company than thats out of my realm of experiance

Regardless of your concerns on the cost of anything, do the right things for yourself to be back in normal. Then contact the insurance company for the further assistance to be followup on their procedures.

You most likely don't have medical coverage with your insurance (i.e. you don't have full coverage) - now the other persons insurance co knows it - and will screw you.


Get a lawyer ASAP.
 
If you really did get a neck injury from this (which I used to think was just bs until it happened to me) do NOT take the guys insurance company's settlement offer. They'll probably try to offer you something like $1000 in exchange for you waiving your right to sue. Do not take it. You can suffer from a soft tissue or neck injury for a very long time to come and sometimes pain might come and go. Sometimes it doesn't even set in to begin with until several days later. Don't do anything hasty just because they flash some bling at you. I'm not saying commit insurance fraud either though. Just be honest and make sure you give yourself plenty of time (months) to see if you are going to have any long term pain or injury from this accident before you think of taking a settlement.

i drive a 1987 Corolla GTS, and the other guy was driving an IS350..2007 i believe
 
What Insurance Co. do you have? It should not be your responsibility to work directly with the other company, its your reps responsibility. Ask for a supervisor. l

then go to the doctor and find out what your bills are going to be...

So I guess I should get a Lawyer?

I saw some advertisements on the way to work today about law firms specializing in automobile accidents.
 
You have to watch the lawyers too. They can be a lazy bunch. Sometimes they are wheeling and dealing with the Insurance Cos behind your back. Basically your settlement is done and they have the fee in pocket before you really know whats happening. I would stick to your Insurance Co and like glue to be handling this.
 
Thanks for all the advice guys... i have a dr's appt tomorrow morning... then i'll probably look at getting a lawyer.
