First Amendment interpretation at its finest: 9th Circuit upholds anti-porn law for overseas military personnel

Of all the things the federal government has to be concerned about, they're making a fuss over whether some private stationed overseas can buy a Hustler at the post exchange. Yes, i know that Congress passed the law, Bill Clinton signed it, and the 9th Circuit just upheld it, but still Mr. Bush (and AG John Ashcroft) aren't above blame in all this too, they continued the fight in the 9th circuit after all. And of all courts to uphold this bit of wasted US Code, it had to be the 9th Circuit. The same court that held the Pledge of Allegiance to be unconstitutional now finds that the 1st Amendment really is subject to interpretation.

Mr. Bush, don't you have something better for the Department of Justice to spend manpower and taxpayer dollars on than this?
 
The board has allowed some magazines to remain on sale, including Playboy and something called Celebrity Skin. Among those banned are Penthouse, Hustler and Playgirl.

Isn't John Ashcroft the numbnut that wanted the justice statue with the tits hanging out to be covered up?? What a f*&king pansy-assed loser.
 
Not that i agree with it, I don't think that the constitution has any protection for obsene speech that lacks redeeming social value. It's just that the courts generally don't step in because that is a devious distinction; whether something has redeeming value or not. Another point is that people in the military don't have all the same rights that normal citizens have.

They didn't "continue" the fight, the US government was being sued in federal court by the porn mags, they had no other choice. The Justice Department has an OBLIGATION to defend the laws of the land.
