filing for Bankruptcy in California

does anyone know how one qualifies for personal Bankruptcy in California? I'm sure that not just anyone can go out and qualify for it. Your debts probably have to out weigh your income or something.

My friend and I just took someone to small claims and won $700 and $2000 respectively. Now upon threatening to claim that money, the defendent has warned us that he'll probably have to file for Bankruptcy even though we're not going to collect all at once (probably garnish wages over several months period).

Anyone have an advice on this?

Really not much you can do about it. A judge will decide the bankruptcy issue and your friend may be out the money.

Winning a judgment is one thing, collecting is entirely another. If I really didn't want to pay a civil judgment, they'd never see a penny of it.

I just wanted to know if anyone knew anything about filing for Bankruptcy. I'm sure someone has had some experience with it. I didn't realize that it was the wrong topic for an off topic forum. But it sure got off topic.

Bankruptcy may not be a way out for him/her. In some states monies owed for civil penalties, or from a judgement, can not be discharged by a bankruptcy. Consequently, a bankruptcy may not erase the debt owed to you. Call a lawyer and find out. You may be able to have a lien placed on his/her property if they have any, or have thier wages garnished.
