Fell down some stairs in a nightclub last night...

I was out in a club in Liverpool last night. I got there still sober, and bought a drink and then walked down the back stairs. The staircase is steep, has cracked tiles on it and by this point in the night are always extremely slippery. There are no signs warning of this, and everyone knows its a complete deathtrap!

That said, I have walked down these stairs a hundred times over the last year or so and I know they're slippery. But in this case I slipped on a step about half way down, grabbed some big air then landed awkwardly with the edge of the step hitting the small of my back, and my elbox smashing on something (not sure what). Worst of all, my beer went everywhere.

Obviously on the night it was extremely painful, but nothing was broken. My elbow was bleeding a lot and my back was difficult to move around too much but otherwise fine. This morning my elbow is very stiff and difficult to move around too much, and my back is just aching. My neck is aching also.

Now I don't want to sound like a big wimp, if I'd had these injuries playing sport, I'd just put up with it. And let's be honest, even if the owners don't give a crapabout the safety of their customers, it was pretty stupid of me to fall down the stairs in the first place. I felt like an idiot anyway.

But on the other hand, it is only a matter of time before someone does seriously hurt themselves on this staircase (trust me if you saw it you'd be amazed its in a busy club). I'm pretty sure I have claim, but probably not for very much money. I don't like the idea of suing people for a fall, but if it were a safe staircase and just an "accident" it wouldn't cross my mind for a second.

What does everyone think?

If you know it is a dangerous staircase and you were not careful and managed to fall anyway, SUE THE PANTS OFF OF THEM :roll:

Call the club today and give them an ultimatum: "Fix the stairs or I'm going to call a lawyer and you'll be dealing with this legally."

Next time you're there, if they haven't fixed the stairs, call a laywer and sue them. There's nothing wrong with suing if it's justified, but give the other party a chance to make things right first. And document your injuries now!

I doubt they'd fix them.

The problem is they are narrow, steep, dont think theres even a handrail, they are tiled, and usually build up condensation.

We go to this club cos its a dive and cheap, but you don't expect to leave in pain!

UNless you notified the manager at the time of your fall, you probably will lose in court. They can just claim it never happened. Maybe if you had witnesses but still they will ask why did you not seek help right after you fell.

Well as it happens, I told the woman behind the bar who didn't seem to care. I asked to speak to the manager. I explained to her what had happenned, and said that it's got to be sorted out because I wasn't drunk, I wasn't rushing and I wasn't fooling around, but I somehow ended up in a heap on the floor.

She said I could have a free drink, which I took. It was only when I got home that my friend said to me they really need to sort it out, he and a few others saw me fall down.

And yeah I don't have a strong case because I'm not really very badly hurt. But I just think something should be done about the offending stairs.

With today's 'suing culture' I'm positive people would take this up just cos they want money. But I don't particularly want to do that. But then if everyones doing it?.... etc

Yeah well I was quite pleased with the drink, although it wasn't really free, I'd already paid for it then during slip had spilled it.

Basically I think if I'd had hurt myself seriously I'd do something about it. The thing that bothers me is that someone could just as easily hurt themselves badly as had a few bruises like me. The negligent act (or ommission) of the owner is the same regardless of the injuries.

There's your answer. That's what you should have been working on since the first time you realized it was a complete deathtrap instead of waiting until you got hurt or someone else actually died. Now you've got some leverage so maybe talking to the owners about the stairs will get results. If not, there are always the authorities that oversee such things.

Sorry you had to get hurt in order to start the fixing process. Hope it all works out.

File a lawsuit for eleventy billion dollars or whatever, get on the front page of the paper with the headline:

LOCAL DRUNK SUES BAR FOR ELEVENTY BILLION

Then, dismiss your own case. Cause you won't win.


The bad publicity will probably make them fix the stairs.

Is there no handrail? I'd talk to the owner and ask if they'd put up a handrail. Then I'd let it go.

Yeah, I think I may take it up with them.

At least if I do raise it, they ignore it, and then someone does seriously hurt themselves... well, theyre screwed.

Hmm trouble is I think I'm sounding like a whinging little baby. If you see someone fall down some stairs you first think is he//she alright? You then think he/she is very drunk, very stupid or a combination of the two. And I suppose that's what the manager thought of me to be honest!

But I wasn't drunk! Seriously!

Eleventy billion though. Sounds tempting.

I would only sue if you actually now have some medical expenses. But you could always let them know what happened and have them fix the stairs (rubber grip mats on the edges or something) or that you will sue them in order to make that happen. It'd be to their own benefit to do it but sometimes places need a little coaxing to get off their lazy asses for things like that. A lawsuit usually has that effect.
