this has happened many times already and i just hear beep everytime i pick up.

Telephone Consumer Protection Act of 1991

The Telephone Consumer Protection Act (TCPA), a federal law, imposes restrictions on the use of automatic telephone dialing systems (also called autodialers), artificial or prerecorded voice messages, and fax machines to send unsolicited advertisements. The FCC adopted rules and regulations, effective December 20, 1992, implementing the TCPA. Different rules and regulations apply to calls placed to homes and calls placed to businesses. The rules do not apply to messages sent via e-mail or the Internet. The rules include a prohibition against calling a consumer at home who has asked not to be called again.

The TCPA specifically bans the transmission of unsolicited advertisements to telephone facsimile machines. If, however, the caller has an established business relationship with the intended recipient, then expressed prior consent is assumed until a "do not fax" request is received.

By law, each fax transmission must have a header or footer that clearly states the caller's name, telephone number and the date and time of transmission. All fax machines manufactured after 12-20-92 must have the capacity to print this information on either the first page or, preferably, every page of the transmission. Again, the company or person on whose behalf the fax has been sent is ultimately responsible for compliance.

Sweet, thanks i had no idea such laws existied.

They exist and they work. I'll be filing in small claims soon against some jerkoff down in Albany GA who thinks it's clever to send spam faxes to my home number between 2 and 5 in the morning. He's not going to be laughing when I sue for $1500 per fax. :|

Junkfax.org has good info on the laws and how to apply them.
 
Had a similar thing happen here, contacted the Security Dept of the local phone Company (BellSouth) and they helped stop it.

Actually, I did. I sent him a fairly polite fax explaining that I'm not a business and I don't want to receive any faxes (I don't even have a fax machine). I got a fax call at 5am the next day. :|

I'm setting my PC fax software to "receive" tonight before I head to bed. If he calls again and I intercept the fax, I'll file in small claims court under the TCPA. He's liable for $1500 per fax (3x the normal amount) since he's "willfully" sending unwanted faxes (ie- I asked him to stop and he didn't). This should be entertaining.

Filing in small claims court will run you anywhere from $30-50 or so. I think I can handle that.

How to file suit in GA magistrate court.
At the time of filing, the plaintiff must pay a filing fee which includes the charge to serve one defendant. This fee varies by county and can range of from approximately $45 to $55. An extra charge for service for any additional defendants usually ranges from $25 to $35 per defendant.
