Ok, I am trying to apply for my FASFA Government Aid today and I looked at the requirements. I meet all requirements to receive my pin but my father does not as he did not fill out his tax forms this year.

Can I use my mother as my guardian instead of my father even if I dont live with her and rarely visit?

I am filing for Fasfa 09-10. The thing is, my mother was able to include me on some sort of medicaid plan and a food card thing for my sister and I. She does help out financially but I live in my Dad's apartment.

I would say no because you live with your father and not your mother. I'm pretty sure they want the person you live with.

You asked earlier how to commit fraud. Well, take some clues from your mother.

Who claims you under their tax return? That is the tax info you need. and btw it is FAFSA not fasfa.
