Open Carry is illegal in Charlotte and Durham, but legal in the rest of NC. It simply is not tolerated in either city given their more liberal nature and the war zones that lie within.

I really wish people would stop parroting NC's Open Carry as a legit reason for the police to not approach this guy. The fucking gun was in his hand. That is not Open Carry.

In the current NC case, the guy was not walking around. He was in his vehicle.

Holding your gun in your hand in your vehicle or out is not open carry.

Secondly... I don't care what the open carry assclowns interpret as the law, if I'm pulled over with a firearm I have in my vehicle and I do not have a CCW permit I am going to be in for a fun time wiggling out of a weapons charge even it it is "openly carried" in a holster on my hip.

Ideally? Not a fucking penny. Realistically? Enough to make them go away quietly.

Now, if they find the officer(s) were negligent in some small way? Sure the family deserves some restitution. Time will tell as this plays out. Given there are no findings yet or charges... I'm doubtful there will be.

Okay, the idiots' position is that cops began to screw with a guy, shot him dead, and then only later fortuitously discovered that he was armed, on drugs, and had a history of shooting at cops.

I feel that the actual shooting was justified, he had a gun in his hand and wasn't complying with the police, I do question the probable cause, you can have a gun in your car in NC, you can have a gun in your hand in your car in NC.

Obviously, he was a criminal, and it turns out even the gun was stolen, again, not a tough guess as he was a convicted felon and wouldn't pass a background check.

The whole BLM protests are out of line IMHO, and the rioting of course is criminal. I'd like to see Soros charged with something for funding BLM and promoting that shit.

The police only need reasonable suspicion to initiate a stop (although technically, they can initiate a consensual stop).

As for him carrying the gun, I thought I had read that the officers had actually seen him exit the vehicle once before carrying it. So, when they confronted him, that was actually the second time he came out of the vehicle with a gun.

It's easy though to miss Emperus' point - that cops need to be trained to de-escalate. It's one thing to shoot him if shoot him you must, but if he's not in any position to threaten anyone but himself, backing off and spending some time trying to talk him down is arguably* a moral thing to do. Also, having ONE marksman aiming a gun at him lessens the chance of striking an innocent if it does devolve to gunfire, and having one cop pointing a gun at him might make him less aggressive than having a bunch point guns at him. (Even though for a normal, non-Darwin Award person it's just the opposite.)

*Arguably because with this guy's history, it's entirely possible that if talked down here, this guy would have gone on to murder someone once he's out on probation with yet another illegally obtained weapon. Illegally obtaining weapons and shooting at people (especially cops) is kinda his thing. But that risk is essentially the same whether he drops the gun immediately or after a four hour stand-off.

PC was met with the drugs, brandishing the gun was icing on the cake. Perhaps it might not get a conviction but the basic elements of brandishing appear to be there.

As Justoh points out, this is true only in legal theory. Felons are by definition not people with much respect for the law.
